Repeal land acquisition amendment and scrap Godda Adani Power project: demands Jharkhand civil society

Ranchi: Repeal Land Acquisition Amendment Act 2018 (Jharkhand) and Land Bank policy. Laws that are blatantly and repeatedly used for suppression of freedom of expression and harassment of activists should be immediately repealed. Few examples are Sections124A (sedition) & 499 (criminal defamation) of the Indian Penal Code (IPC).

All the projects that are being undertaken without consent of Gram Sabha and by violating land laws should be scrapped including, Icha-Kharkai embankment, Godda Adani Power project, Palamu elephant corridor and Mandal dam. Samta judgement, Fifth Schedule and PESA should be implemented in letter and spirit. Rules for PESA to be formulated. Forest Rights Act should be enforced fully. And there should be complete transparency in funding of political parties.

These and many other significant demands were made by Jharkhand Janadhikar Mahasabha from all political parties to include it in their manifesto, for 2019 Lok Sabha Elections.

The Mahasabha is a coalition of more than thirty progressive organisations, activists and intellectuals working in different parts of Jharkhand for the rights of poor, Adivasis, Dalits, women and minorities.

“Mahasabha believes that our state and country are passing through a phase of undeclared emergency. Peoples’ rights and basic tenets of democracy are under attack: amendment in Land Acquisition Act, starvation deaths, lynching incidents, increasing atrocities on Adivasis, Dalits, minorities and women, state-sponsored communalism, attacks on the freedom of expression, harassment of activists, attacks on traditional self-governance systems of Adivasis, to name a few,” read the press communiqué issued by the mahasabha.

Jharkhand Janadhikar Mahasabha hopes that 2019 elections will lead to formation of a government that will be committed to ensuring people’s rights, preservation of constitution and democratic institutions and committed to secular and democratic values.

JJM also mentioned that it will discuss the question of political commitment on these issues with the people across the state.

Below are mahashabha’s demands in full:

Gram Sabha and Natural Resources

  • Repeal Land Acquisition Amendment Act 2018 (Jharkhand) and Land Bank policy. No amendment, against the interest of Gram Sabha and people at large, should be made in land laws. Land taken over or identified under these policies should be immediately returned to the owners / Gram Sabha.
  • All those projects that are being undertaken without consent of Gram Sabha and by violating land laws should be scrapped Icha-Kharkai embankment, Godda Adani Power project, Palamu elephant corridor, Mandal dam are few examples falling in this category.
  • Samta judgement, Fifth Schedule and PESA should be implemented in letter and spirit. Rules for PESA to be formulated. Forest Rights Act should be enforced fully and all community and individual claims should be accepted.

Civil and Democratic Liberties

  • Laws that are blatantly and repeatedly used for suppression of freedom of expression and harassment of activists should be immediately repealed. Few examples are Sections124A (sedition) & 499 (criminal defamation) of the Indian Penal Code, Unlawful Activities (Preventions) Act and National Security Act. All fabricated cases filed under these laws / provisions in Jharkhand should be withdrawn.
  • Immediate release of under trial prisoners languishing in Jharkhand’s jails since a long time. Immediate release of Adivasi under-trials, falsely branded as Naxals (more than 3000 in number).
  • Repression by administration and security forces in Khunti district by claiming Pathalgarhi to be unconstitutional should be immediately stopped. All cases to be withdrawn, police camps to be winded up, victims to be compensated and perpetrators of repression should be punished.

Domicile and Reservation

  • Present domicile policy of the state to be repealed. Instead domicile policy to consider only those who are native inhabitants of Jharkhand as local residents to be formulated.
  • Rules should be framed to ensure maximum participation of local residents in decision-making positions at all levels of all government and private jobs. At least 50% reservation should be ensured for Adivasis, Dalits, and backwards in promotion in government jobs. At least 33% reservation should be ensured for women in all areas. All vacant posts in all departments should be filled within one year of formation of government.
  • Provision of 10% reservation for financially weak candidates (which is primarily a reservation for savarnas) should be scrapped since this provision is against basic principles of reservation and social justice.

Social Security, Healthcare and Education

  • Universal basic services and social security for all citizens to be guaranteed for – food, nutrition, universal common education till secondary level, and maternity benefits. Aadhaar-based biometric authentication should be removed from all welfare programmes and public services and Aadhaar should not be made mandatory for any welfare programme and public services.
  • Universal PDS with at least 7 kg food grain per person, pulses and edible oil. Expansion of Dal-Bhat Kendras with improved services. Social security pension of at least Rs 3000 per month for all elderly, specially abled, single women and members of particularly vulnerable tribal groups. Maternity benefits of at least Rs 6,000 per child to all pregnant women (without conditionalities). Cooked nutritious meal, with six eggs per week, for all children in Anganwadis and midday meals in schools.
  • Expansion of employment guarantee programme to urban areas and for skilled labour as well. Expansion of the right to work for every rural family under NREGA to 200 days per year with minimum Rs 300 per day wages or minimum wage of the state, whichever is higher.
  • Expansion of Right to Education to cover equal and free education for all children up to Class 12. Order of merging schools should be recalled by Jharkhand govt and closed schools should be reopened.
  • All citizens should be provided common, free and quality health services through public health system. Delivery of government health services to be strengthened at all levels, especially for primary and preventive care.

Agriculture

  • All recommendations of Swaminathan Committee should be implemented and farmers should be paid procurement price of 50% over and above the C2 cost of cultivation. All surplus produce of farmers should be procured on time. One-time comprehensive loan waiver. Control of all forest produce should be vested with Gram Sabha.
  • Irrigation facilities based on rainwater, rivers, rivulets and existing dams should be ensured. Irrigation management should primarily be done by Gram Sabha and at secondary level by Panchayati Raj institutions.
  • Cow Protection Act of Jharkhand should be scrapped and restrictions on trade of animals should be withdrawn.

Religion, Culture and Language

  • Freedom of religion act, Jharkhand should be scrapped. Adivasi religion, by the name of Sarna or some other name (decided by the Adivasi communities), should be officially recognised.
  • Adivasi and regional languages of Jharkhand should be used in official communications and these should be made additional medium for education in schools.
  • Special provisions and schemes for comprehensive development of minorities based on recommendations of the Sachar Committee. Separate budget provisions should be made for minority communities.

Transparent, Accountable Governance and Electoral Reforms

  • Complete transparency in funding of political parties. Restrictions imposed for lodging complaints by citizens on public representatives and government officials should be withdrawn. Right to recall elected representatives should be made fundamental right.
  • Sanctity of Right to Information Act should be maintained, without any form of dilution. A decentralised grievance redress mechanism should be established in the state. Online facility for filing Right to Information applications in the state to be established.

Why leaving Giridih Lok Sabha seat may cost dearly for BJP in Jharkhand

Ranchi: The news of Bharatiya Janata Party (BJP) getting into an alliance with All Jharkhand Student Union (AJSU) for 14-Lok Sabha seats in Jharkhand did not surprise many. As AJSU is in National Democratic Alliance (NDA) and both parties had fought together during 2014 assembly polls. But BJP leaving Giridih Lok Sabha seat for AJSU has shocked everyone, from BJP leaders to political pundits.

In doing so, BJP has left a seat at a place, where the party has not lost in the past 30 years last in Lok Sabha polls (except two for time – in 1991 and 2004, when Jharkhand Mukhti Morcha (JMM) had won).

And most significantly, the sitting Member of Parliament (MP), Ravindra Pandey who has been denied ticket from Giridih has won five times.

Also it’s not only about Pandey, but Giridih is one of the few seats in Jharkhand, where all the electoral heads – MP, MLA, Mayor and Deputy Mayor belongs to the BJP.

While some are saying that AJSU is not a strong party base in Giridih to win a Lok Sabha seat. It is not easy also for BJP that it votes can be transferred to AJSU candidate. The latest example is AJSU president Sudesh Mahto loosing from its traditional seat- Silli, despite BJP’s alliance in 2018’s bypoll. In most cases, a ruling party or its alliance win in bypoll, but here Raghubar Das led BJP government rule could not change fate of AJSU chief who has been voted out twice between 2014 and 2018.

AJSU has five MLAs in Jharkhand assembly.

The first reaction of Giridih MP was also not to believe the news, “Where you have heard that Giridih seat has been given to AJSU. The parliamentary panel has only decided to get into an alliance with AJSU and give them one seat, but it is yet to decide on the seat,” he reacted while talking to eNewsroom.

When asked if anybody from party had contacted him, the reply from the five times MP was a big no.

Later, Pandey told other media organizations that he had not been contacted by the party before such a major decision, “It seems BJP is a big party now and where a five time MP had no importance to be contacted before such decisions.”

Significantly, the adjacent Lok Sabha constituency’s BJP MP, Ravindra Rai too, expressed shock which has been reported in newspapers, in regards to the decision of giving Giridih seat to AJSU. He has termed the decision as being suicidal for the party.

Rai’s statement is important, as he has been Jharkhand’s state president for BJP, and under his leadership, BJP had fought Lok Sabha polls in 2014 and won 12 out of 14 seats.

“As it was being believed that because of poor performance, Ravindra Pandey would not be getting the ticket this time. But by changing the candidate, BJP can win the seat. However, it seems, like BJP was under pressure from AJSU for the Giridih seat, which they have grabbed,” said Amit Raja, senior journalist while talking to eNewsroom.

While another senior journalist, Kamal Nayan said, “In the last two days, I met many BJP workers, and found that there is a bit resentment among them, they are not happy with the party’s decision. However, they may not hit the streets to protest against the decision, but they will express this anger while casting their vote.”

Survey conducted by many television news channels telecasted on the eve of poll date announcement, has confirmed the fear of the BJP being turned into reality, with the NDA being limited to three seats in Jharkhand.

Political observers believe that BJP’s decision to not contest from Giridih seat will have a direct impact on at least three other seats – Koderma, Dhanbad and Godda.

Rahul Gandhi finds a staunch admirer in Babulal Marandi

Giridih: In an exclusive interview with eNewsroom, Babulal Marandi, the first Chief Minister of Jharkhand claims that he is an admirer of Congress President Rahul Gandhi. The words have great significance, as 61-year-old Jharkhand Vikash Morcha (JVM) chief is considered a seasoned politician. Marandi has been four-time Member of Parliament (MP) and also a Union Minister in Atal Bihari Vajpayee’s cabinet. Marandi, who formed JVM after quitting Bhartiya Janata Party (BJP) seems to be bowled over by Rahul Gandhi’s simplicity, also feels that PM Narendra Modi should abstain from making fun of the Gandhi scion. With Lok Sabha election round the corner, Marandi talked at length. Following are the excerpts of the engaging conversation that covered right from Rahul Gandhi, his party’s fight against forcible land acquisition for the Adani Power in Godda, and the status of the Mahagathbandhan (grand alliance) post-Pulwama attack:

eNewsroom: How much faith do you have on Congress President Rahul Gandhi?

Babulal: When we are forming the Mahagathbandan with the Congress, which is the largest and oldest party, we accepted its leader Rahul Gandhi, as the Gathbandhan’s leader too.

On a personal level, I have watched him closely to arrive at this understanding that Rahul Gandhi thinks about the country, about the common man and the poor. His lifestyle is very simple and wherever he goes, he appears to be like one of the common man. There is no show off even during press conferences and he definitely tries to connect them. So I think such young leaders should be supported. If an alliance happens then it will be good. And in these many years I have assessed that what he says, he does it.

eNewsroom: Recently at an event in India’s premier engineering institute, Prime Minister Narendra Modi poked fun at Rahul Gandhi, on the pretext of asking a question to one of the innovators working on a programme that can help Dyslexic children. How do you see it, especially when you have just admitted that you admire Rahul Gandhi’s simplicity?

Babulal: I always have maintained that be it Modi ji or anybody else, we should not criticize others. Everyone has their own style of speaking, reading and doing things, everyone has their own uniqueness. Earlier people used to address him as Pappu and Yuvraj too, which is wrong in democracy.

He comes from such a family background where Motilal Nehru was a lawyer, Pandit Jawahar Lal Nehru was also a qualified lawyer and served the nation as its Prime Minister. Trimurti Bhavan is a living example of their legacy.

What I mean to say is, even after coming from such royal background he still leads a simple life. Wherever I saw him, be it at the Parliament or anywhere else, I have found him being humble.

Even being in politics and at this age, he did not try to look different but tried to connect with the common man. At least in this matter, I am a fan of him.

His personality should not be made fun of, he can be criticized for the wrong decisions he takes. Even I can or will oppose things which I will not like.

eNewsroom: Your party has been fighting against the forcible land acquisition in Godda by the government for Adani Power Plant. Several JVM leaders have gone to the jail for protesting against it, but the Jharkhand government has not just supported it but has also declared the entire power plant area as an SEZ (Special Economic Zone). How you see it?

Babulal: We have fought a lot, both on the road and inside the assembly. But the government has planned to support Adani power plant. However, it was because of our opposition that they have managed to acquire only 500 acres of land, they actually had planned to acquire 2000 acres of land. The compensation amount was earlier reduced to Rs 3.5 lakhs per acres, which has now been increased to Rs 50 lakhs per acre. But yes with regards to the SEZ order, I will say that the Modi government should declare entire Jharkhand or even Santhal Pargana as SEZ, as it will benefit Adani Power Plant.

eNewsroom: Has the terrorist attack in Pulwama, followed by the air strikes made you and others in Mahagathbandhan, rethink the strategy?

Babulal: Yes, immediately after the Pulwama attack, followed by air strikes it looked as if BJP would be benefitted during the elections. But the way the BJP leaders misinformed people, only for their claims to be rubbished by the international media. Also, Imran Khan not wasting time in releasing Abhinandan dented Modi and Amit Shah’s propaganda. A minister even said, “We did not go to kill anyone”. So, the government is now on back foot, which makes clear that it was a political stunt. BJP should not politicise the incident. I think it may now have a reverse impact.

eNewsroom: But Amit Shah has mentioned the number of terrorist killed, while PM Modi has stated – Gush Kar Marenge….

Babulal: If you want to kill, then go and do so, who has stopped you? But it’s like jo badal garajte hai wo baraste nahi (Thundering clouds seldom rains). America did not say anything before entering Pakistan to kill Osama. They even threw his body into the ocean. But we did not kill anyone and are shouting. These days nothing can remain hidden. Media is omnipresent. Strangely enough, all international media has denied any killing.

The 300 terrorists getting killed from the airstrikes have, in fact, made a mockery of India before the world.

Martyr’s wife waits for job and land promised to her

Giridih/Ranchi: Reshmi Updhyay was only 19 when she got married. However, within four years, she became a widow. Reshmi, is the wife of martyr Sitaram Upadhyay, a constable of Border Security Force (BSF), who was killed on May 18, 2018 when Pakistan violated cease fire in the Jammu border.

Sitaram is survived by two children, a three-year-old daughter and a two-year-old son.  Reshmi, who is single child of her parent, has a difficult life already as not only is her father is deaf, but her father-in-law is also blind. Martyrdom of Sitaram, has made things even more unbearable for her as her family is now having to survive without any steady source of income.

Making things difficult for her is the Jharkhand government.

“It has been over 10 months, but I have yet to get the job and land that had been promised by the government. The land had been promised at two places, one in the township, for residential purpose and other in rural area for agricultural. But, at least I should get the residential purpose land,” Reshmi told eNewsroom.

She further narrated, “But more than the land, I am in need of a job. As now I have to think about the future of my children. I have got a certain amount as compensation from BSF and the state government, but if I will spend them now, then I do not know what will happen in the future. In the hope of getting job, I did not apply for any petrol pump or gas agency license as then I may not get job.”

Reshmi, who had left her graduation midway wants to become a graduate too, by appearing for the final year course.

The widow, till date has met three deputy commissioners of Giridih—Manoj Kumar, his successor Neha Arora and her successor Rajesh Pathak, a dozen times. Reshmi also wrote for Jan Sanwad, a public hearing platform which is organised by the Jharkhand chief minister Raghubar Das. But she is yet to get any response.

She has also been invited by the Jharkhand cabinet minister Dinesh Uraon to attend Jharkhand Vidhan Sabha foundation day function.

“On November 22, when the foundation day of Jharkhand Vidhan Sabha was celebrated, I had been called to attend the event. During the event everyone, including the ministers promised of getting me a job soon, but it is yet to happen,” she rued.

A forth night ago, Reshmi had met deputy commissioner Rajesh Pathak, who had promised her that during the meeting of Sthapana Samiti (emplacement committee), a decision would be taken.

When contacted Deputy Commissioner, Giridih Rajesh Kumar Pathak, he told eNewsroom, “The meeting had held and the committee has agreed for Reshmi Upadhyay’s job.”

But the widow, who is eagerly waiting for her job, and met officers several times, have not got any official communication about the development.

“I did not receive any information regarding it. Hope it has been done and soon i will hear about it,” she added.

While her job process may have pushed forward, but the land promised to her yet to be provided. And the big question is, why even after such show of high respect for armed forces by political parties, still a martyr’s widow has to run pillar to post to get what she has been promised by governments?

BJP’s misrule is making us unsure of when a war or riot will happen: Hemant Soren

Giridih: “Today the condition of our country is such that at borders, army men, who in general are the son of farmers, are getting killed, while farmers are being forced to commit suicide inside the country because of BJP’s misrule. BJP is neither capable of handling state nor country,” said Hemant Soren, the former Chief Minister and Leader of Opposition, Jharkhand.

Soren junior was addressing a rally on the occasion of the 46th Foundation day of JMM, Giridih at Giridih’s Jhanda Maidan. During his half an hour-long speech, the former chief minister also addressed the crowd in the local tribal language.

“Today the situation is such that anytime a war can be declared, here in Jharkhand, anytime a communal riots can be instigated,” he declared. “Now, the time has come to think for everyone and arrive on a decision about who should be given the charge of the country, for then only the constitution and democracy will be saved,” Soren said.

The JMM leader especially highlighted, how during the BJP rule, atrocities was being inflicted on tribals and schedule caste. He said, “The way atrocities is being inflicted on tribals and schedule caste across India it has never happened in the history of India. How the forest and lands belonging to the tribals of Jharkhand has been looted. Gair Majurwa Land is being converted into government land banks and is being looted. The animal husbandry has been ruined. Cattle markets have been shut down. Children belonging toTribal and schedule caste community are unable to study as schools are being closed in rural areas.  ”

He then added, “If you hope for something from this government, the you will have to face the bullet or stay behind bars. However, with election around they are luring the common man with schemes, they will give money to us in February and loot us from March.”

Expressing anguish over what has been happening off late, he said, “What BJP did is – create fights between the tribals, forward and backward castes and the minorities. Even para-teachers died in large numbers when protesting, as they fought for their rights. A large number of lynching cases, which never happened in the past 18 years, has place in Jharkhand. Due to lynching, we lost many friends from the minority community, but surprisingly, the killers are being garlanded by BJP leader Jayant Sinha. What the hell is going on in the country?”

Just ahead of addressing the rally, JMM working president told in a press briefing that the politics on air strikes, is not in the interest of the country, but BJP is playing it the most. “BJP is connecting the bravery of armed forces to itself,” alleged Soren.

He also claimed that BJP during its tenure has given nothing but displacement, migration and unemployment to the people of Jharkhand.

“The policy of state government is to give power to Bangladesh, water to Bihar and employment to outsiders. In fact, the chaal and charitra of BJP have been anti-Jharkhand,” he alleged.

On the recent Supreme Court order for the eviction of tribals from forest area, Soren said, “Both the centre and state governments did not present the tribal’s perspective before the court; they have been asked to evict the forest. It was only after a mass protest, that the government had filed a petition in the court.”

Martyrdom drowned in cacophony of vote seekers in Patna

Patna airport got two ‘guests’ landing in the gap of a couple of hours today.

The first to land was the body of the CRPF inspector, Pintu Kumar Singh who attained martyrdom fighting against militants at Handwara in Kashmir. Pintu was one of over 65 Indian jawans killed in terror strikes and the continuing gun battle on the borders in the aftermath of the blast at Pulwama.

The second to land was Prime Minister, Narendra Modi for NDA rally at the Gandhi Maidan at Patna. Hundreds of the BJP-NDA leaders, ministers, ticket seekers and vote-seekers accorded Modi, a hero welcome and escorted him through the streets strewn with flower petals and bedecked with garlands, colourful posters and attractive bill boards.

Of course, the Bihar Congress chief, Madan Mohan Jha accompanied the district magistrate and superintendent of police, Patna to pay customary tribute to the coffin carrying Pintu who had made supreme sacrifice at the borders. But the ruling BJP-JDU leader and ministers were missing.

The martyr’s body was flown to his Dhyanchakki village in north Bihar’s Begusarai district where his sulking relatives, grieving villagers and friends cremated him at the nearby bank of the river Ganga.

Some NDA leaders issued press statements to mourn Pintu’s death while others feebly mentioned him on the dais. Like the politicians, the mainstream media and TV channels largely ignored Pintu and showed Modi speaking on his ‘grand revenge’ against Pakistan through surgical strike and air strikes. The crowd cheered him too.

Frankly admitting that the blast triggered by a suicide bomber at Pulwama that killed 40 CRPF jawans had shaken me, fuelling anguish in my mind. The patriotic sentiment overwhelmed me. But the brazen way in which the Prime Minister and his party men and allies displayed that doing politics and winning election was their only prerogative has disturbed me to my wits end.

The motorcycle born Bajrang Dal, RSS, BJP and NDA cadres had been carrying out ‘victory processions’ on Patna streets to create atmosphere for the PM’s rally for the last two days. All the roads coming to Patna had been made one way to allow the people to enter Patna for the rally. The residents of Patna could not have left for other places for the exit roads had been blocked.

Victory processions for what? Have the alienated people of Kashmir stopped from indulging in militancy? Has Pakistan Army begun the process to dismantle the terror camps aiding, abetting and supporting militancy in Kashmir valley? Were the terrorist camps smashed and terrorists killed in the surgical strikes and then air strikes? Modi roared at the Gandhi maidan, “The opposition parties are asking for evidence of air strikes and surgical strikes. Their words and utterances are demoralising our security forces and triggering celebration and clapping in Pakistan. We are here to fight against terrorism”.

Ridiculous! The opposition is there to raise questions and the Prime Minister is supposed to reply them. In the democratic set up, the media channels too have been invented to serve as watchdogs, raising questions at the powers that be. Sadly, most of the channels are admittedly mongering war and creating war hysteria instead of carrying out investigation into the security lapses that led to the blast at Pulwama and the reasons which have scaled up militancy and unrest manifold in Kashmir during the Narendra Modi led rule. I don’t say that the militancy in Kashmir has happened only due to Modi’s misrule. But it is a fact that the militants have carried out more raids and have slain more jawans during Modi’s rule. And his so called surgical strikes and air strikes have not yielded any visible improvement in the situation at the ground level.

Some election analysts and poll pundits say that Modi’s ‘actions’ against terrorists and Pakistan have whipped up nationalistic sentiment across India which will help the BJP and its allies at the upcoming elections. Others say that the issues of unemployment, farm crisis, economic disorder triggered by demonetisation and GST and loss of jobs due to closure of several establishments have been drowned in surgical strikes and air strikes across the borders giving upper hand to the BJP led NDA in elections.

Let me candidly admit that I neither claim to be a big poll analyst nor an adroit pundit on elections. It is for the people to decide if Modi should stay or get replaced by others in office. But I don’t see anything tangible that the BJP has achieved in containing the crisis in Kashmir and halting terrorism. In fact, the problems have increased—be it on the borders or in the countryside across India. Stung by communal disturbances, farm crisis, unemployment, poverty, atmosphere of hate, loot of millions of rupees from the banks and fiddling with constitutional institutions, people might be looking for an alternative. Still we don’t know if they will get the desired alternative.

Coming back to martyr, Pitnu Kumar Singh: Pintu was among five brothers. Having graduated from L.S. College, Muzaffarpur, he had joined the RCPF as inspector in 2009. He was married to Anju Singh in 2011. He has left behind his distraught wife, Anju and a four year old daughter besides other brothers and family members. He had come to his village during last Chhat festival and had promised his family and friends to come again during Holi. He had called his brothers and wife on the fateful day informing them that he was locked in the vicious encounter with the militants. He had promised that he would call them again once he was free from the encounter but he didn’t call as he met his martyrdom the same day. He had initially joined the CRPF camp at Motihari but was later transferred to Kashmir.

Navruna case: Saga of misinformation and manipulation

Patna:“Ek machhar sala aadmi ko hijra bana deta hai

Roughly translated, this dialogue of thespian, Nana Patekar, in the film, Yashwant means: “One mosquito can turn a man into a eunuch”.

This dialogue hit the lips of the movie goers in 1997 when the film Yashwant was released. But the famous dialogue aptly reflects the dubious role of a self styled RTI activist who has botched up a tragic case involving the abduction and murder of a teenage girl, Navruna Chakravarty in north Bihar’s Muzaffarpur town in 2012.

The way a tiny mosquito incapacitates even an able and all powerful human being by stinging him in his sleep, the self styled RTI activist virtually incapacitated the premier investigating agencies—the Central Bureau of Investigation (CBI) and Bihar’s Crime Investigation Department (CID)—from carrying out proper investigation in the case. The ‘activist’ played on the mind of the deceased, Navruna’s parents, confusing  the latter and goading them for non-cooperation with the investigating agencies concerned.

How did it happen in the case involving the snatching of a young life and then generating barrage of misleading media reports in the last six years? Read on the sequence of events to decode the answer:–

  • A Muzaffarpur city resident, Amulya Chakravarty lodged an FIR about abduction of his teenage daughter, Navruna with the city police station on September 19, 2012. The FIR (507/12) stated that the unknown criminals had twisted his house’s window rods to make space for incursion and had abducted Navruna. The police station registered the case under sections 364/366 (a) of the Indian Penal Code (IPC) and set in motion the process of investigation.
  • The police didn’t act swiftly in the case which, apparently, led the media and nosy reporters carrying out numerous reports on the issue in the local dailies and other instruments of the news dissemination.
  • The buzz in the media on the tragic issue obviously drew the attention of the Bihar Chief Minister and also a Supreme Court judge from Bengali society who suggested the then Additional Director of Police, Muzaffarpur, Gupteshwar Pandey—now Director General of Police (DGP), Bihar– to inspect the case at his level. Normally, an ADG rank officer doesn’t delve in such cases which are supervised and handled at the level of Superintendent of Police (SP) or Deputy Superintendent of Police (DSP). But Pandey—known for his pro-active role in policing over the years—hit the spot with DIG, SP and scores of his other subordinate police officials about 40 days after the lodging of the FIR. The media was seized with the issue and, thus, scores of reporters and cameramen too reached the spot of occurrence to cover the episode.
  • Pandey spoke to Amulya Chakravarty, his wife and his relatives to understand the issue. He perused the files and found out lapses in the process of investigation. Subsequently, he wrote a letter on October 10, 2012, pointing out loose ends in the investigation and directing the officials concerned to carry it out in a swift and diligent manner. Pandey’s initiatives speeded up the process of investigation.
  • Two and half months after this episode, a decomposed body was recovered from a pit, just five steps away from Amulya Chakravarty’s dwellings. Naturally, the recovery of the body from the vicinity of the house of Amulya whose daughter had been abducted created anxious curiosity in the city with hundreds of people converging at the place and imperilling law and order. The ADG, the district magistrate and several police officials apart from the media men reached there to find about the decomposed body close on the heels of Amulya’s house which had lost its teenage dweller.
  • The police asked Amulya to identify the body. But to the surprise of one and all, Amulya’s brother was taking his lunch as usual on the dining table. Neither Amulya nor any of his family members came out to see the body. “It might be the body of cat or dog. We have nothing to do with it”, Amulya said tersely and in the process got away from cooperating with the process of investigation. It was the second and last time the ADG—now Bihar DGP—had inspected the case which subsequently was transferred to the CID and then to the CBI.
  • The forensic investigation established that the body was that of a 15 year old girl which led the investigators to conjecture that it might be of Navruna’s. The investigators asked for the DNA test of Amulya who refused the same. The court concerned also asked Amulya to undergo the DNA test in the interest of the investigation that Amulya refused to abide by. Amulya’ refusal for DNA examination virtually halted the investigation. Media came out with many speculative stories on the issue. The parties approached the Supreme Court which ordered CBI inquiry. The CBI investigators eventually made Amulya undergo the DNA examination which testified that the body, of course, belonged to Navruna. The DNA report proved conclusively that Navruna is no more in this world and the CBI had hit the right nails in the investigation.

NEW TWIST LACED WITH MISINFORMATION AND IMBROGLIO:

ADG, Gupteshwar Pandey who had, long ago, turned his attention away from this case after it had gone to the CID and then CBI was on way to Patna—Bihar capital—for an official meeting in the last week of the December, 2012. He got a call from a woman who was distraught and weeping. She complained to him that she was a bank official and a person was relentlessly pestering her on way to her bank, ogling at her, passing lecherous remarks, writing uncalled for letters and chasing her. She told Pandey over phone that she would commit suicide if he didn’t rescue her from the “Romeo” in question. An aver alert police officer, Pandey spoke to the Muzaffarpur Superintendent of Police and got connected that woman to the SP. Pandey was extra cautious because the woman had complained at the time when the entire country was on fire because of the rape  and killing of NIRBHAYA in Delhi. The woman didn’t reveal her tormentor’s name. The police sleuths in plain cloth lurked at the place which the complainant had indicated. The sleuths had a success as they caught hold of the man indicated by the harassed woman. They seized his mobile phone which contained several text messages to the woman and objectionable letters, making it to the police dossier and lodging a case against the man.

This tormentor of the woman happened to be one, Hemant Kumar—the self styled RTI activist—who was, somehow, acquainted with Gupteshwar Pandey and expected the latter’s ‘favour’ in the case. But Pandey didn’t know that it was Hemant whom the police had nabbed for tormenting the woman bank employee. Hemant was soon bailed out by the police from the police station.

Now,  Hemant Kumar, working under the shield of the RTI activist, turned heat on the police station, demanding removal of the police station in-charge for ‘defaming’ him and besmirching his prestige. Then he turned heat on Pandey, unduly targeting the latter for ‘defaming’ him. Pandey was flummoxed for he was unable to decipher why Hemant was targeting him, planting numerous unverified stories against him in the media. Pandey was transferred to Patna in April 2013. Hemant lodged a case against Pandey with Muzaffarpur Chief Judicial Magistrate alleging that Pandey had orchestrated his arrest in the case pertaining to harassment of the woman. The CJM exonerated Pandey after finding the case to be false. Hemant for unexplained reason began baying for Pandey’s blood and lodged a case in vigilance court questioning Pandey’s admission in law, his questionable TA bills and loss of an AK-47 riffle which couldn’t stand the scrutiny of the law and dismissed.

A conversation with the cross section of people at Muzaffarpur revealed that Hemant was trying to gain media limelight by targeting Pandey—a high profile IPS officer known for his integrity and smart policing. Hemant drove his nose in Navruna case trying to engineer the people’s anger against Pandey. He and one of his accomplices, Abhilek Ranjan displayed placards and bill boards spreading falsehood about Navruna case’s investigation and tried to disturb the Prime Minister’s meeting. The enraged people beat up Hemant for mischievously raising question on the CBI and investigators. He worked on the mind of Amulya Chakravarty and relatives misleading them about the case and questioning the CBI’s role. He has carried out numerous misinformation campaign against Pandey, CBI and others on the Facebook and other social media sites.

Thus, this is the time to end this story by quoting the dialogue once again: “Ek machhar sala admi ko  hijra bana deta hai”. It is now reasonably easy for the readers to discern who that machhar (mosquito) is in Navruna case, biting and confusing the CBI and even the mighty Indian judiciary.

Kamal Nath as MP Chief Minister is a disappointment, at least so far

Kamal Nath, 72, as Chief Minister of Madhya Pradesh has been a disappointment. At least so far. He has been active in Parliament since 1980 when he was elected to the Lok Sabha for the first time. He has handled several ministries at the Centre admirably. It was expected that he would, as Chief Minister, provide a good government to the State by toning up the administration. But he started with a handicap. He had little choice either in picking up his ministers or allotting them portfolios. Nor has he been able to control the wayward bureaucracy or the ‘criminals in uniform’ as MP’s police force was once described by the State High Court.

After a procrastinated tussle with Guna MP Jyotiraditya Scindia (who was chairman of Campaign Committee during the poll campaign), PCC chief Kamal Nath was selected to be the leader of the Congress Legislature Party (CLP). He took oath as Chief Minister on December 17. Selection of ministers turned out to be more difficult. Scindia and former Chief Minister Digvijaya Singh ardently pressed the claims for their supporters. Several meetings were held in Bhopal and Delhi. At one stage even party president Rahul Gandhi intervened. The only point of agreement was that the first time MLAs should not be included in the Council of Ministers. Haggling continued for over a week. In sheer exasperation, Kamal Nath accepted the names and appointed 28 ministers. As Scindia and Singh were said to be insisting on cabinet rank for some of their supporters who had never been ministers in the past, Kamal Nath gave cabinet rank to all of them. Only six of them were with previous experience as ministers, while 22 had been made ministers for the first time. He distributed the departments as demanded.

Within days of formation of the cabinet, the Kamal Nath government courted controversy by invoking National Security Act (NSA) against three persons suspected of cow slaughter in Khandwa district. Former Jammu and Kashmir Chief Minister Mehbooba Mufti and former Uttar Pradesh Chief Minister Mayawati condemned it and wondered if there was difference between BJP government of Uttar Pradesh and Congress government of Madhya Pradesh. Even Digvijaya Singh, who is the real force behind the Kamal Nath government, publicly criticised the decision to invoke NSA.

The government tried to blame it on the district administration. The fact is that the government is completely directionless. The law and order situation, which was pretty bad during the previous BJP government, has been further deteriorating after formation of the Congress government, with heinous crimes like murder, rape and molestation being reported from various parts. The kidnapping of two six-year-old twins from the school bus at gun point in Chitrakoot and recovery of their bodies 12 days later have raised questions about the efficiency and honesty of the State’s police. The father of the twins is an industrialist of the area and was said to have paid Rs 20 lakh as ransom against the demand of Rs one crore. The police had claimed to have pressed 500-strong posse to scour the area and sealed the entry points to the adjoining Uttar Pradesh. Later it emerged that the children were kept at Chitrakoot itself for two days and then taken to Uttar Pradesh and the 500-strong police force scouring the area had no clue. Or had the police cut a deal with the kidnappers for a share in the ransom?

Not only has Kamal Nath failed to give directions to the police and the bureaucracy but to his cabinet colleagues also. The ruling party faced a great embarrassment when his ministers justified in the Assembly the previous government’s ‘misdeeds’ which the Congress government had made an issue in the election campaign. A ‘colossus blunder’ was committed by Home Minister Bala Bachan when he justified police firing on farmers in Mandsaur district on June 6, 2017. The Congress had all along been agitating against the wanton police firing. Party president Rahul Gandhi visited Mandsaur on the first anniversary of police firing on farmers and declared that farmers’ loans would be waived within ten days if the Congress came to power. Mandsaur police firing on farmers had become a major part of Congress campaign for the elections.

In 2017, then BJP Chief Minister Shivraj Singh Chouhan had made a parikrama of river Narmada and got six crore saplings ‘planted’ on the banks of the river. Later Digvijaya Singh made a parikrama of the holy river and claimed that there was no trace of the saplings and the huge amount spent on the plantation had been misappropriated. Earlier, the Chouhan government was accused of bungling to the tune of Rs 4500 crore in organising the Ujjain Kumbh Mela. These too had been made part of the Congress election campaign against the BJP government. However, Kamal Nath’s Forest Minister and Urban Development Minister ruled out any bungling or irregularity in the Narmada plantations or Kumbh Mela management. Digvijaya Singh was furious. More so, because Urban Development Minister is none other than his own son, Jaivardhan Singh, who is a second time MLA.

Nearly a thousand transfers have been effected in the past two months. Some of the officers were transferred and retransferred within days. Kamal Nath had appointed Bhupendra Gupta, R K Miglani and Sanjay Shrivastava as Advisers to the Chief Minister and made them Officers on Special Duty (OSDs). They resigned to take up some political assignments — only a month or so later.

Red Rose Movement to nip hatred begins from Kolkata

Kolkata: Taking a cue from the white rose movement, the non-violent intellectual way of opposing the Nazi regime, Apne Aap World Wide joined hands with 14 other NGOs, colleges and universities from Kolkata to spread the message of love and peace.

Like the rest of India, Kolkata too joined hands to condemn the Pulwana terror attack and the recent racial discrimination that the Kashmiri students, traders and tourists are facing across the country.

The participants from the various universities, women right activists and members of various non governmental agencies assembled at the Kolkata Press Club on Saturday to launch the #Red Rose campaign to spread the message of peace and harmony. The campaign aims at gifting a red rose to someone who is from a different religion, caste, sexual orientation and region to pledge love and friendship.

Talking to eNewsroom, Ayush Sarda of Ek Packet Umeed, “I was talking to Ruchira over the phone stating that the red rose is a symbol of love globally and at the same time it is a non-political symbol. So this is why ‘rose’ was selected,” said Sarda, the brain behind the campaign.

Journalist-turned-social activist Ruchira Gupta, added, “The students community need to be more proactive as they can bring in the change that the society needs. Hate cannot conquer hate, love alone can conquer hate.” Quoting Rabindra Nath Tagore, she said, “Humanity above everything so let humanity be our new religion. Let’s move ahead to foster friendly and humane relations with our fellow beings.”

Shaneena Javed, the feisty woman right activist from Raja Bazaar narrated one incident of her school days that has left an indelible mark on her psyche. “One day a friend of mine from school casually asked me whom will I support in a play off between India and Pakistan?” She then rhetorically, with a choked voice answered, “Like our forefathers we would be buried in this soil still people will question our love for India.”

When asked what she thought about the Red Rose Campaign, she said, “I think that this campaign should travel to every nook and corner of Bengal. A dialogue needs to be fostered so that people understands and supports us and in turn spread the message of love and harmony across society.”

Student activist of Presidency University, Rimjhim Sinha who participated with her team, narrated, “A 17-year-old boy was handed over to police because of his comment about the current political disturbance. He said that he doesn’t support war and stood firm in his conviction. He didn’t give into the adverse situation. The boy was granted bail, later.” Economist and women right activist Saswati Ghosh, chairperson of West Bengal Commission for Protection of Child Rights Ananya Chakraborti, Reeta Chakravarty of Bangladesh Bharat Pakistan People’s Forum were present to support the campaign. Members of Syaam, Gender Bender, Know Your Neighbour, Yeh Mera India, students of Calcutta and Jadavpur Universities were also present at the occasion.

West Bengal, the new den to exhibit your nationalism

Kolkata:  West Bengal, which always proud of its diverse culture has recently witnessed several clashes and riots between communities, and now it has also become the focal point of exhibiting the high voltage nationalism, as for one reason or other people are being thrashed and termed ‘anti-national’.

Post Pulwama terror attack a series of mob violence has taken place across Bengal.

On Tuesday night, in Nadia district, a Kashmiri trader Javed Ahmed Khan was beaten badly.

A mob comprising 30 people stormed into his rented house, and beat Khan.

The mob beat him when a local boy of about 17 years, posted Khan’s picture with an inciting post on Feb 18 on his Facebook wall.

The post written in Bengali stated, “This Kashmiri brother who used to play with us when I was in Class IX, has made some remarks in favour of Pakistan. He has a shop in the market area. Enough! Let’s settle things brother.”

The teenager who posted the video of the assault on his Facebook wall deleted it after circulating the video.

The local police station is keeping a strict vigil to avert any undesirable incident. “Khan is safe. We would not let anything like this happen again,” said officer-in-charge, of Taherpur police station, Avijit Biswas.

According to the locals, the family of the boy is a hardcore BJP supporter. At least five persons reportedly arrested in connection with assault of Kashmir traders.

In Nadia district, in the last couple of years, has witnessed several incidents of communal violence. This is the third major incident in the small town during the last three years. Church vandalism took place in 2015 and destruction of Trinamool Congress office in 2017.

OC Abhijit Biswas confirmed that Javed Ahmed Khan has not written anything on his Facebook wall in favour of Pakistan. So the allegations were completely false. No complain had been lodged against the boy by anyone.

After the Pulwama terror attack, a series of mob reaction is happening across Bengal. Irrespective of religious identity, the Hinduvta mobs are targeting those who are voicing their opinion against war or last week’s terror attack.

A first year college student Anik Das, a resident of Coochbehar district of North Bengal was made to apologise for his post on social media. A video has gone viral on social media where the mob was seen barging into the house of Das whose father used to work for the Border Security Force. They were calling Das ‘anti-national’ because the mob accused him of sharing a voice on social media where he had allegedly said that he doesn’t love his country. The mob demanded that Das should be handed over to them.

Both the parents were in extreme shock. The disturbed mother was seen slapping her son in front of everyone.

As soon as Das was handed over to them, they surrounded him. The mob forced him to kneel down on road and raise slogans like ‘Pakistan Murdabad’ and ‘Indian Army Zindabad’. He was even made to do sit ups holding his ears.

Das’s ordeal lasted for 15 minutes that ended when he wrapped a tricolour around him while raising patriotic slogans.

In another incident, a mob gathered at the residence of a school teacher Chitradeep Shome in Bongaon, North 24 district. He was confronted over his post on social media where he allegedly questioned the use of the term ‘martyr’ for those killed at Pulwama terror attack.

Shome clarified that a section of his comment was being circulated out of context. But the mob was not in a mood to listen to him. They forced him to raise patriotic slogans while forcing him to touch ground with folded hands and apologize live on social media.

While Kashmiris, living in Kolkata or other parts of state for years now, have been on line of fire. eNewsroom had reported about a Kashmiri doctor getting death threats, and his daughter even faced discrimination in society, two Kashmiri students were also got beaten in Durgapur.

While it’s a major law and order issue, so far, the Kolkata Commissioner of Police, Anuj Sharma who replaced Rajeev Kumar told media persons after assuming office that Kashmiris are safe in Bengal.
