কলকাতা: খড়গপুরের ছাত্র আইআইটিিয়ান ফয়জান আহমেদ হত্যা তদন্তের জন্য গঠিত বিশেষ তদন্তকারী দলকে কলকাতা হাইকোর্ট 19 ডিসেম্বরের মধ্যে চূড়ান্ত প্রতিবেদন জমা দিতে বলেছে, আইআইটিিয়ান ফয়জান আহমেদ হত্যা কৌঁসুলি এসআইটি প্রধানকে চিঠি দিয়েছেন। অভিযুক্তদের নারকো এবং ট্রুথ সিরাম বিশ্লেষণ পরীক্ষা পরিচালনা করুন, জুন মাসেই হাইকোর্টের নির্দেশে।
আইনজীবী অনিরুদ্ধ মিত্রের আইপিএস অফিসার জয়রামনের কাছে লেখা চিঠিতে বলা হয়েছে, যিনি এসআইটির নেতৃত্ব দিচ্ছেন:
“আপনি জানেন যে আমার মক্কেলদের দায়ের করা একটি রিট পিটিশনের উপর মাননীয় বিচারপতি রাজশেখর মন্থার 14.06.2023 তারিখের একটি আদেশের মাধ্যমে, আইআইটিিয়ান ফয়জান আহমেদ হত্যা তদন্তকারী নবগঠিত টিমকে নারকো বিশ্লেষণ এবং সত্য সিরাম পরিচালনা করার নির্দেশ দেওয়া হয়েছিল। হত্যাকাণ্ডের বিষয়ে আলোকপাত করার জন্য প্রয়োজনীয় কোনো সাক্ষী বা ব্যক্তিদের পরীক্ষা করা হবে।”
এতে আরও উল্লেখ করা হয়েছে, “যেহেতু এটি 22.11.2023 তারিখে মাননীয় আদালতে দল কর্তৃক দাখিল করা প্রতিবেদনে জমা দেওয়া হয়েছিল যে IIT-এর অনুরোধে তাদের পরীক্ষার অভিযোগের ভিত্তিতে 25.11.2023 পর্যন্ত শিক্ষার্থীদের জিজ্ঞাসাবাদ স্থগিত করা হয়েছিল। কর্তৃপক্ষ, আমার ক্লায়েন্টরা বিশ্বাস করেন যে এই ধরনের জিজ্ঞাসাবাদ 14.06.2023 তারিখের নির্দেশিত নির্দেশ অনুসারে একটি অর্থপূর্ণ পদ্ধতিতে পরিচালিত হবে, এবং বেপরোয়াভাবে নয় যাতে অভিযুক্তদের চিহ্নিত করা হয়, হত্যার জন্য মামলা করা হয় এবং হেফাজতে নেওয়া হয়।”
চিঠিতে আরও উল্লেখ করা হয়েছে যে আদালতের আদেশ অমান্য করলে আদালতের নজরে আনা যেতে পারে।
“14.06.2023 তারিখের আদেশে উল্লেখিত পূর্বোক্ত নির্দেশের অ-সম্মতি পরবর্তী শুনানির তারিখে মাননীয় আদালতের নজরে আনা হবে।”
চিঠিতে 14 জুন, 2023-এর হাইকোর্টের আদেশও সংযুক্ত করা হয়েছে।
আইআইটিিয়ান ফয়জান আহমেদ হত্যা মামলার বিষয়
14 অক্টোবর, 2022-এ, তৃতীয় বর্ষের মেকানিক্যাল ইঞ্জিনিয়ারিং ছাত্র ফাইজান আহমেদের আংশিক পচা মৃতদেহ আইআইটি খড়গপুরের হোস্টেল থেকে উদ্ধার করা হয়েছিল। খবর পেয়ে আসামের তিনসুকিয়ার বাসিন্দা ফাইজানের বাবা-মা যখন খড়গপুরে পৌঁছলেন, তখন আইআইটি কর্তৃপক্ষ দাবি করেছে যে 23 বছর বয়সী এক ছাত্র আত্মহত্যা করেছে। পরে পুলিশও একই ধরনের বক্তব্য দেয়। তবে অভিভাবকদের অভিযোগ, তাদের ছেলেকে হত্যা করা হয়েছে। ময়নাতদন্তের পর মৃত্যুর কারণ জানতে পারেনি খড়্গপুর পুলিশ। কলকাতা হাইকোর্টের দরজায় কড়া নাড়লেন অভিভাবকরা। আদালত পুলিশের কাছে মৃত্যুর কারণ জানতে চাইলেও তারা সন্তোষজনক জবাব দিতে পারেনি। বিচারপতি রাজশেখর মন্থার আদালত মৃত্যুর কারণ খুঁজে বের করার জন্য ফরেনসিক বিশেষজ্ঞ অজয় গুপ্তকে নিয়োগ করেছে। ডাঃ গুপ্তা প্রথম ময়নাতদন্তের ভিডিও ক্লিপিংয়ের মাধ্যমে রক্তক্ষরণের লক্ষণ খুঁজে পান এবং নতুন পোস্টমর্টেম করার জন্য আদালতকে অনুরোধ করেছিলেন। তিনি কলকাতা মেডিক্যাল কলেজ হাসপাতালেও এটি করাতে চেয়েছিলেন। আদালত অনুমতি দিয়েছেন। ফাইজানের মৃতদেহ আসাম থেকে কলকাতায় আনা হয় এবং দ্বিতীয় ময়নাতদন্তের পর স্পষ্ট হয় যে আইআইটিিয়ানকে খুন করা হয়েছে। বিচারপতি মান্থা আরও তদন্তের জন্য একটি বিশেষ তদন্ত দল (SIT) গঠন করেছেন। 14 জুন তার আদেশে বিচারপতি মান্থা আরও উল্লেখ করেছেন যে প্রয়োজনে দল অভিযুক্তদের নারকো বিশ্লেষণ এবং সত্যের সিরাম পরীক্ষা করতে পারে। আইআইটি কেজিপির পাশাপাশি বাংলা সরকার এসআইটি দ্বারা তদন্ত বন্ধ করার জন্য ডিভিশন বেঞ্চে চলে যায়, কিন্তু ডিভিশন বেঞ্চ যেটিতে কলকাতা হাইকোর্টের প্রধান বিচারপতিও ছিলেন, বিচারপতি মান্থার আদেশ বহাল রাখেন।
গত শুনানিতে, 28 নভেম্বর, জয় সেনগুপ্তের আদালত, যেখানে বর্তমানে মামলাটি শুনানি হচ্ছে, তার ধীর তদন্তের জন্য SIT-এর সমালোচনা করেছিল।
Kolkata: As the Special Investigation Team, formed to probe the murder of IIT Kharagpur student Faizan Ahmed has been asked by the Calcutta High Court to submit its final report by December 19, the counsel of IITian Faizan Ahmed has written to the head of SIT to conduct Narco and Truth Serum analysis test of the accused, as directed by the high court in June itself.
The letter written by advocate Aniruddha Mitra to IPS officer Jayaraman, who is heading the SIT stated:
“You are aware that by an order dated 14.06.2023 passed by the Hon’ble Justice Rajasekhar Mantha on a writ petition filed by my clients, the newly constituted team investigating the killing of Faizan Ahmed had been directed to conduct Narco Analysis and Truth Serum tests on any witness or persons deemed necessary to throw light on the killing.”
It further mentioned, “Since it was submitted in the Report filed by the Team in Hon’ble Court on 22.11.2023 that interrogation of the students had been deferred till 25.11.2023 on the alleged ground of their examinations at the request of the IIT authority, my clients trust that such interrogation shall be conducted in a meaningful manner as directed by the said order dated 14.06.2023, and not in a perfunctory manner so that the accused are identified, booked for murder and taken into custody.”
The letter also pointed out that non-compliance with court orders can be brought to the notice of the court.
“Non-compliance of the aforesaid direction contained in the order dated 14.06.2023 will be brought to the notice of the Hon’ble Court on the next date of hearing.”
The letter also enclosed the high court Order of June 14, 2023.
About IITian Faizan Ahmed murder case
On October 14, 2022, the partially decomposed dead body of third-year mechanical engineering student Faizan Ahmed was recovered from his hostel at IIT Kharagpur. After getting the news, when the parents of Faizan, a resident of Tinsukia, Assam reached Kharagpur, IIT authorities claimed that a 23-year-old student had committed suicide. Later police also gave a similar statement. However, parents remain alleging that their son was killed. After the postmortem, Kharagpur police could not ascertain the cause of death. Parents knocked at the door of Calcutta High Court. The court also asked the cause of death from police, who could not give a satisfactory answer. The court of Justice Rajasekhar Mantha appointed forensic expert Ajoy Gupta to find out the cause of death. Dr Gupta after going through the first autopsy’s video clipping found haemorrhage signs and requested the court for a fresh postmortem. He also wanted to get it done at Calcutta Medical College Hospital. The court granted the permission. Faizan’s body was brought from Assam to Kolkata and after a second autopsy, it got clear that the IITian was murdered. Justice Mantha constituted a Special Investigation Team (SIT) to probe further. In his order on June 14, Justice Mantha also mentioned that if necessary the team can perform Narco Analysis and Truth Serum tests on the accused. IIT KGP as well as the Bengal government moved to the division bench to stop the investigation by SIT, but the division bench which also comprised the Chief Justice of Calcutta High Court, upheld the order of Justice Mantha.
In the last hearing, on November 28, the court of Jay Sengupta, where the case is presently being heard had critized SIT for its slow investigation.
Kolkata: Women in India are on the verge of getting one-third reservation in the Indian parliament. They are excelling in the political, social, diplomatic, and cultural arenas. Saira Shah Halim, an educator and rights activist, stated during the Non-Aligned Movement (NAM) conference in Baku in 2023.
The NAM conference, focusing on advancing the rights and empowerment of women was held on November 20 and 21.
The conference was co-organized by Azerbaijan, the current chair of the Non-Aligned Movement, as well as Uganda and Uzbekistan, the next chairs of the organization.
On the first day of the conference, a side event organized by the Institute of Young Democrats provided an opportunity for NAM Member States and NGOs to discuss themes such as women’s rights, empowerment, and other critical gender equality issues.
Institute of Young Democrats Chairperson Yegana Hajiyeva said, “We are honored to host this gathering of esteemed guests and participants, all of whom are representatives of NAM member countries. This unprecedented event marks a significant step forward for the NAM region, demonstrating our unwavering commitment to women’s empowerment and gender equality.”
In her speech, the specially invited guest, Saira Shah, also informed the gathering that the legal marriage age for girls in India has been increased from 18 to 21.
“We also have a program called Beti Bachao, Beti Padhao (Save Girl Child and Educate Her), she informed NAM members.
“There is a plethora of women voices in India, and women are doing wonders in the political arena, social arena, diplomatic arena, and cultural arena,” she mentioned.
When Saira was delivering her speech, the screen in the background was displaying profiles and pictures of Indian women achievers.

Despite India’s progress, challenges persist
However, the rights activist also addressed the challenges still plaguing India, particularly impacting the women’s community.
“Female infanticide is still being practiced in India,” Saira, the mother of two daughters, also mentioned. “The social injustices like the dowry system are also a norm, where society thinks that girls are a burden. But activists are talking about this discrimination and making people aware that girls are equal to boys.”
“There are a large number of villages where electricity is yet to reach. Because of this, a huge part of the country, especially girls, have no exposure to digitalization or computerization,” Saira expressed concern.
She talked about the uniqueness of India and mentioned that every state in India is a different country because of its diversity. There are hundreds of languages and dialects being spoken in India.
[dropcap]T[/dropcap]he safe return of the 41 workers trapped in the Silkyara tunnel near Uttarkashi in Uttarakhand, is a matter of great satisfaction for the entire nation. Kudos to all those involved in the rescue operation for the last 17 days. The tale must have been horrifying but the way we saw the smiling workers coming out, reflected their energy level despite all odds. Yes, in one sentence, these are the sons of the soil, who toil hard to make our lives better.
There are three issues involved here. One, which has been projected by the government is the rescue effort to save the lives of the people and we must give full credit to those who were involved in it. All the agencies of the government did this herculean task with a great sense of duty. The result is the government has been able to send a signal to the families of the workers trapped that it cares for their lives and would go to any extent to protect their lives. Perhaps, the government has succeeded in communicating this message. Every government or party does that and the government would take all the credit for the successful operation. So Congratulations to all those who were involved in it.
The second part is the company engaged in the operation which remained out of sight and out of scrutiny till now. Who gave them the contract and whose company is this? Whether it flouted the norms of tunnelling in the region where a safe passage must have been prepared in advance. Will the accountability be fixed for this company?
And the third is the most important part and it is the policy level decision. How long will you rob the #Himalayas? Will the government and its advisers ever think to maintain the sanctity of the Himalayas and that they can not really claim victory over nature? Please don’t try to tame the Himalayas. If you feel your big machines and experts can tame the Himalayas then you are grossly mistaken. At the end of the day, it was the rat miners who took us to ultimate ‘victory’. It seems that the government has still not learnt its lessons from various disasters that have been occurring in the Himalayas. This year, Uttarakhand saw terrific rains, landslides, cloudbursts and floods but in the din of an unprecedented crisis that happened due to Himachal rains, it was lost. The fact is that even in Himachal, the massive devastation that has happened was not purely ‘natural’ but purely the outcome of the concretisation process and building of various hydropower projects which we are unable to manage properly. ‘Experts’ with greed feel that states like Uttarakhand are not able to use their maximum potential of the Hydro Power projects and are advising the government to go for bigger projects. The Char Dham High Way is not yet completed and most of the time the roads are getting ‘thrashed’ by the mountains. We all need good roads but we have to understand the fragility of the Himalayan regions. Anyone familiar with the Uttarkashi region will vouch for how sensitive it is. Nobody denies making our roads comfortable but it also needs to be seen how much comfort we want to give to ‘people’. Don’t make the region flooded by religious tourists which will ultimately bring destruction. A small place like Kedarnath, where five thousand people at one time is an extremely high number, is hosting lakhs of people. Will it not damage the sacred areas? How are you going to meet the daily needs of the people? Where is the ‘sewage’ system?

It looks like we don’t care about what is happening to local people. After the 2013 Kedarnath tragedy, developmental projects have increased and so have the disasters. The 2021 disaster at the Raini-Tapovan area particularly on the Rishiganga-Dhauliganga confluence showed the might of nature again when the entire hydropower project got swept away, apart from the lives of several hundred workers mostly outside Uttarakhand. Joshimath and many other towns in Uttarakhand are endangered. So far, not much has been done. After a few months, we forget things.
We request policy planners to think seriously about all the projects in the Himalayas. Maintain the dignity, sanctity and serenity of the Himalayas and its sacred rivers worshipped by all. Don’t destroy our heritage, for the Uttarakhand region, they are our identity.
The incidents also reveal that the projects in Uttarakhand are so far not giving any employment to local people. Whether in Tapovan or Silkyara tunnel, most of the workers and labourers working are outside the state which reflects how the companies do not trust local people and bring the outsiders to get their things done.
The servile media convert every tragedy into an event and focus on these events so that people don’t discuss the real issue of safety and protection of the Himalayas. As the rescue operation has succeeded and thanks to all those who worked day and night to do this task, it is time, for the government to seriously ponder over and order an audit of all the projects in the Himalayan region.
I am still remembering the warning by legendary Girda about this ‘development. He was a visionary. He still reminds us about the Himalayas and development. Says, Girda,

These wise words of Girda, the Jankavi of Uttarakhand are still valid for all. Will we ever learn our lesson? The Himalayas need our attention. They enchant us and give us enormous joy, standing for us as our borders. It is time, we bow to its might and respect it and enjoy its beautiful localities for which a bit of inconvenience should be acceptable to all. You can’t have all your home luxuries travelling to the abode of nature. Let me say, that there can be no luxury than enjoying the beauty of the Himalayas and its supremely pristine rivers and rivlets. Let us all protect and respect them.
It was a pleasant surprise to see former Prime Minister Vishwanath Pratap Singh on the front pages of Manustream Media. Though they would never have given him space in today’s time it was an advertisement provided by the Tamil Nadu government and Bania Brahmin media is ready to do anything for the cash. That is the commitment. I was amazed to see the front page of Dainik Jagran, one of the most communal and hate-mongering dailies in north India which used to abuse VP Singh, Mulayam Singh, Lalu Yadav, Ram Vilas Paswan and Sharad Yadav in the aftermath of the government’s decision to implement Mandal Commission Report. Unfortunately, Mulayam Singh Yadav compromised and sent the owner of Jagran, Narendra Mohan to Rajya Sabha later but look at the attitude of the paper. It is terribly communal and anti-social justice even today. So, VP Singh on the front pages of such newspapers must have given a rude shock to those who were happy with his not being around. So, newspapers were happy to ignore the passing away of VP Singh, in Delhi, on November 27, 2008 as they were busy reporting the Mumbai terrorist attack. They completely ignored his death but today’s advertisement therefore must have shocked them but then they had to take it with a pinch of salt.
While Manustream media or casteist Brahmanical leaders of both BJP and Congress may have a point to ignore VP Singh because he brought the issue of social justice to the mainstream of India which was still dominated by the caste elite, the silence and ignorance of those who enjoyed fruits of power and can be safely said to have benefitted from his policies though Lalu Yadav and Ram Vilas Paswan remained close to him till the end the real strength to VP Singh came from Karunanidhi who party DMK, organised a massive rally in favour of the Mandal Commission Report when the north Indian leaders were calculating pros and cons of his politics.
More than 35 years have passed since VP relinquished his power but he remains absolutely essential for the politics of social justice and secularism. Unfortunately, the social justice parties in north India started ignoring VP to get the votes of the savarnas. That is why to please the Brahmins and Banias in particular, the Samajwadi party and Mulayam Singh Yadav went out of his way to get them plum posts. The dominant caste journalists always enjoyed the curtsy of the Samajwadi Party. Can you imagine, a person who was twice chief minister of Uttar Pradesh, a finance minister of the country, President of Uttar Pradesh Congress, a Defence Minister as well as the Prime Minister of India, does not have anything in the name of memorial in the country. We have a big memorial for Sanjay Gandhi without him being any minister but we don’t have anything for a man who altered the political discourse in the country.
While Congress and BJP can be faulted for the same. The pain and disappointment come from other parties including RJD. For the last 35 years, Uttar Pradesh and Bihar had mostly Janata-Samajwadi parivar ruling but they never bothered. I don’t know the politics in Chennai. I am not sure why Lalu Yadav, Tejasvi or Nitish were not invited to unveil the statue of VP Singh. It is obvious that the Congress party might not have liked the idea. Congress’s Brahmanical seculars-liberals have no time for remembering the person as most of them hate the VP for Mandal ‘sin’.
The problem with the Congress party is that it refuses to learn its lessons. I had said many times that had Rajiv Gandhi supported VP Singh when BJP withdrew the support, it would have been a different story today but then Rajiv Gandhi criticised the implementation of the Mandal Commission report on the floor of the house. It was an extremely bad decision. Mandal was an opportunity which Congress lost. After years, Rahul is saying the Caste census but not a single Congress leader repeated it. Except for Siddaramaiah, one does not see the same enthusiasm by Kamal Nath. Unfortunately, Rahul Gandhi and other Congress leaders had no time to say a few good things about VP Singh. Frankly speaking, Congress acted like the BJP at that time when VP Singh was forced to quit. We know how the Brahmanical leaders of the Congress party right from Kalpnath Rai to Ratnakar Pandey, KK Tiwari were let loose like barking at VP Singh. How the media was misused shamelessly (a pattern that BJP is diligently following now) to target VP Singh. So much so that M J Akbar, a favourite of Rajiv Gandhi was asked to write a false story about VP Singh’s bank account in St Kitts.
Today, the BJP is using the same tactics. Congress needs to learn the lessons. In the VP Congress relationship, it is the Congress party which was the main villain and not VP Singh who remained loyal to Congress ideology and rarely spoke against Gandhis personally.
Whatever the political repercussions, the Tamil Nadu Chief Minister’s one action has made the entire event historical. MK Stalin has proved that he is far more mature than his contemporaries whether in the Congress Party or among the social justice forces. Tamil Nadu has always given due respect and acknowledged the role played by VP Singh. The Dravidian government has put the VP in the company of Dr Ambedkar, Thanthai Periyar, Anna Durrai, and Karunanidhi and it is a big honour. The forces of Social justice in Uttar Pradesh refused initially to acknowledge the VP’s contribution because he was not one among them. It is sad. If we are unable to acknowledge and respect the role played by VP then why would anybody stand up to justice? Stalin’s action made other leaders who enjoyed power in north India, look too small. VP Singh was prime minister for 11 months but his actions shook the power structure. It was he, as a prime minister or man in power, who respected and acknowledged Baba Saheb’s contribution to our country and not only gave Bharat Ratna along with Nelson Mandela but also installed Baba Saheb’s portrait inside the Parliament which was ironically not there. Today, the nation demanded, whether India’s parliament should not have the portrait of VP Singh inside the Parliament. Let the social justice government make a big monument and Smarak of VP Singh in their state as a fitting tribute to the man who was once termed as ‘Raja nahi faqeer hai, desh ki taqdeer hai’. VP Singh certainly deserves better from all of us who believe in social justice and secularism.

Kolkata: The bulldozer justice, which is a new symbol of instant justice in many states of India now, is illegal and unconstitutional, claims Dr Sarfaraz Ahmed Khan, a professor at the National University of Juridical Sciences.
Dr Khan was speaking to eNewsroom, on the sidelines of the Constitution Day celebration function organized by the All India Milli Council’s West Bengal in Kolkata.
“We have seen many bulldozer justice-related cases. Is it legal? No, it is not legal. Everyone has the right to life and personal liberty and one can be deprived of it by procedure established by law. (Art 21). In BJP leader Maneka Gandhi case the Court held that procedure should be just, fair and reasonable,” he answered on the question that bulldozer justice is just opposite to Indian judiciary system but judiciary is not seen doing enough against this practice by many states.
“When something happens, you just go and bulldoze someone’s house, is it just, fair and reasonable procedure? According to me, it is a wrong procedure and illegal. These cases should go to court and victims should get compensation under the Right to Reprisal, the State must pay.
“Unfortunately, the judgment did not come in a day and it takes time. Still, we should get the way to get justice inside the constitution only.”
Earlier, Dr Khan spoke in detail about the importance of the Constitution in India and said to the audience about the fear of a large section of society that India’s Constitution can be changed, and made meaningless.

Article 368 gives power to the constituent assembly, under which with a two-third majority they can amend the Constitution.
“In 1973’s Kesavananda Bharati Judgment, the Supreme Court made it clear that the Constitution can be amended but could not be changed especially its basic structure,” the law professor informed.
The Supreme Court also defined the Basic Structure of it, he added.
On the occasion, Rafay Siddiqui, an executive member of the council, promised to make a team and reach out to educational institutions to make them aware of the Constitution.
Siddiqui also informed that on Minority Rights Day, the Milli Council will hold an event on December 18.
Umar Abedin, Secretary of AIMC, Telangana delivered his speech through video call. He mentioned that it was Prophet Muhammad, who gave the first constituion to the world. He also said, “India will not run through Mann Ki Baat but from the Constitution.”
The programme was also addressed by retired IPS Zahid-ur Rahman.
Milli Council’s other members including Shahud Alam, Mohammad Nooruddin and Gulam Mohammad remained present and addressed the audience.

টাকা
এরপর তিনি উল্লেখ করেন কী কী কারণ গণতন্ত্রকে ফাঁপা করছে। এবং তিনি সর্বাগ্রে উল্লেখ করেছেন টাকা।

ধর্ম
দ্বিতীয় যে কারণটি তিনি উল্লেখ করেছেন তা হলো নির্বাচনে ধর্মকে ব্যবহার করা হচ্ছে, যা গণতন্ত্রকে ফাঁকা করে দিচ্ছে।
নির্বাচনে ধর্মের কোনো ভূমিকা নেই; আপনি একজন নাগরিক হিসাবে ভোট দিন, বিশেষ বিশ্বাস নয়। কিন্তু আজ নির্বাচনে ধর্ম সর্বব্যাপী।

ভয়হীন জীবনযাপন
সবশেষে বিলকিস বানো কি বলেছিলেন মনে আছে। তার পরিবারের ১২ জন সদস্যকে হত্যা করা হয়। যখন তার ধর্ষক ও খুনিরা জেল থেকে মুক্তি পাচ্ছে, তখন তাকে লুকিয়ে থাকতে হয়েছিল। তিনি সুপ্রিম কোর্টে গিয়ে বলেছিলেন, “আমাকে নির্ভয়ে বাঁচার অধিকার ফিরিয়ে দিন।”
ভাবুন তো ভারতের কোনো নাগরিককে যদি ভয় না করে বাঁচতে সুপ্রিম কোর্টে আপিল করতে হয়, নিজেকে প্রশ্ন করুন, এদেশে কত মানুষ ভয়হীন জীবনযাপন করেন? আমি জানি সাংবাদিক, অ্যাঙ্কর ও মিডিয়া হাউসরা আতঙ্কে থাকেন, উচ্চ পর্যায়ের সরকারি কর্মকর্তারা আতঙ্কে থাকেন, সংসদ সদস্যরা থাকেন আতঙ্কে, মন্ত্রীরা থাকেন আতঙ্কে।
ভয়ে বাস করা গণতন্ত্রের পরিপন্থী, আপনি অবশ্যই ভয় ছাড়াই বাঁচতে পারবেন।
হাতে গোনা কত মানুষ নির্ভয়ে জীবনযাপন করছে।

পরে এক প্রশ্নের জবাবে বলেন, কোন সিস্টেমে ভালো? কলেজিয়াম বা নন-কলেজিয়াম, অন্তত কলেজিয়াম সরকারের বাড়াবাড়ি ঠেকাতে পারছে বলে দাবি করেন প্রাক্তন আইনমন্ত্রী।
“ভাবুন, আমাদের যে গণতন্ত্রের রাজ্যে আছে, যদি সরকারের একাই বিচারক নিয়োগের একচেটিয়া অধিকার থাকে, তাহলে এই দেশে কী ধরনের বিপর্যয় ঘটবে,” তিনি বলেছিলেন এবং যোগ করেছেন, “অতএব কলেজিয়াম সিস্টেমের উন্নতি করেনি, আমি মনে করি কলেজিয়াম সিস্টেমের দ্রুত পতনের বিরুদ্ধে একটি প্রতিরোধ।”

Kolkata: P Chidambaram, the Rajya Sabha member and former home minister of India today claims in present democratic India or the ‘New India’ Muslims, the largest minority, are non-citizens. He also mentioned that non-Hindus are half a citizen. In his lecture on the Future of Democracy, the former finance minister bluntly stated many facts about the present Indian democracy, in which according to him most people are living in fear. The former law minister also batted for the collegium system and pointed out that the kind of government India has, the interference will create havoc in the country.
Chidambaram, the senior Congress leader was in Kolkata to launch the book—Development, Decentralisation and Democracy by St. Xavier’s University Vice-Chancellor Felix Raj and Professor Prabhat Kuma Dutta.
During his 45-minute-long speech and speaking to audiences, the seasoned politician, talks about many important aspects of democracy and what ails it. The senior leader, who assumed many portfolios believe that most of the Indians are living under fear and at one point he cited an example of Bilkis Bano’s case where she had to demand from the Supreme Court to give her back the right to live without fear.
Chidambram began his lecture by saying, “If Abraham Lincoln were alive today, he would be called old-fashioned. 106 years back, Lincon said Democracy is of the people, for the people and by the people. But today he apologized for saying it.”
Soon he mentioned, “I am cautious that I am addressing an audience at an education institution that is run by Jesuits, and Jesuits preach Christian faith. I should be very careful not to utter any word that sounds political and partisan. But the fundamental message to be conveyed. And the fundamental message today is, over the years, democracy has been hollowed out in this country. The superstructure is intact, but inside it is practically hollowed out.
Money
Then he mentioned what are the factors that are hollowing democracy. And the foremost he mentioned was money.
Today, 1760 crores of unaccounted money have been seized this month as five states are undergoing polls. Today one state (Rajasthan) has votes and one more is left.
In the initial days of the election, Rs 5000 was sufficient. A few decades ago a candidate could fight an election with Rs 50000 but today money and vast amounts of money are being distributed during the election.
A rally today is a glimpse show. Hundreds of people, with promises of food, drink, song, dance, television screening. And a rally today cost 1 crore.
Religion
The second factor he mentioned is that religion is being used in elections, which is hollowing out democracy.
Religion has no role in the election; you vote as a citizen, not a particular faith. But today religion is omnipresent in the election.
There is a political party which consistently refuses to nominate any candidate other than Hindu in state after state. Although in many states, the proportion of the Muslim population is as high as 20 percent, 15 or 10 percent, the party refuses to nominate a single candidate from the Muslim community, election after election.

Undermining institutions
The third reason why democracy is being hollowed out is, we are undermining the institutions that support democracy. We all think that the four pillars of democracy—parliament
We are moving towards centralism, which is the antithesis of democracy.
Secularism has become a bad word as appeasement
Secularism is so discrete today it has got another name called appeasement. It is a code word to discredit secularism.
If you are a non-Hindu, (pardon me for being blunt) you feel today, that you are half a citizen and if you are Muslim, you feel, you are a non-citizen that is because secularism is being systematically discredited.
UCC, NRC, NEP are anti-democratic
In my view, the Uniform Civil Court is anti-democratic, it will be majority-driven. NRC, the New Education policy is another drive towards centralism.
Today may not know that appointments of the Vice Chancellor, including state-funded universities including DGP require central approval of one or the other agencies of the central government.
State-made laws are ineffective unless the President signs them.
Parliament has made agencies, several agencies, which enter states in the pretext of investigating a crime, a new crime under the new law. And virtually takes over the administration of criminal law from the state government.
Police and law and order are essential state subjects. But usually, you will find that the central agency takes over cases.
Electoral bonds are another way of central power.
Centralism is anti-democratic
Then there is the famous oneness project. One Nation-One Ration Card, One Nation-One Language, One Nation-One Food Habit, One Nation-One Culture, One Nation-One Model Code
All these oneness projects are completely anti-democratic.
He detailed one ration concept and informed that there are 45 million people in India who are internal migrants. “Technically, his ration card should get him ration in another state. But if a migrant goes from Bihar to Tamil Nadu, he will not get ration there.”
Engineering defection
Changing government and not going to the people for a vote but changing government by engineering government is hallowing democracy.
The last state was Goa, which could be the next state, I do not know. Because it can happen in any state.
Racial or cultural supremacy
A leader said we all belong to the Aryan race and that we must aggressively combat Love Jihad and conversion.
A student of a Jesuit school himself, the politician asked the audience, has anyone attempted to convert you? Have you come across in life that Hindu girl who is being abducted by Muslims and Christians? Has it happened to your village and neighbourhood?

Living without fear
Finally, remember what Bilkis Bano said. Twelve of her family members were killed. When her rapists and murderers were being released from jail, she had to hide. She went to the Supreme Court and said, “Give me back my right to live without fear.”
Imagine if a citizen of India has to appeal to the Supreme Court to live without fear, ask yourself, how many people in this country live without fear? I know that journalists, the anchor, and media houses live in fear, government officers at the top level live in fear, Members of Parliament live in fear, and ministers live in fear.
Living in fear is an antithesis of democracy, you must be able to live without fear.
You can count on hand how many people are living without fear.
For all these reasons, India is being termed an electoral autocracy.
India on non-economic matrix
Chidambaram also pointed out the indexes in which India slipped down between 2014 and 2022
On Human Capital Index 100 to 116, Global Hunger Index, we are today 107 out of 111 countries, on the Human Freedom Index- 106 to 115, on the Environmental protection index we have 155 to 180
Gender inequality 114 to 135, on the human 130 to 132, on the Press freedom 140 to 150.
These are non-economic matrices. It will not make us a more developed country.
Among G20 countries, we are the 20th in per capita income and in every other matrix.
Inflation eroded incomes
Inflation has eroded your money, by at least 24 percent. In India’s own statistics, in the 2017-2023 period, in six years, inflation is averaging about 6 percent. There are three categories of people in India who are working self-employed, casual daily labour, and regular job holders.
Self-employed income increased from Rs 12318 to Rs 13347. Applying the inflation, it is negative. The casual labour increased from Rs 6969 to Rs 7899. It is hopelessly negative and regular job holders (Rs 19450 to Rs 20039) are hopelessly negative.
So the average Indian has not become richer. The standard of living has not improved. This has also been reflected in the Family Health Group Survey.
A true democracy is like a high tide, it must lift all, but it is not happening. But our democracy does not lift all.
The bottom fifty percent of India does not have 3 percent of national assets or wealth or 10 percent of the nation. If over 74 crores of people have to share 10 percent of the total income, you can imagine why the way we practice does not lift all.
We have to rediscover democracy, he added.
If govt alone appoints judges, it will create havoc
Later replying to a question, on which system is better? Collegium or non-collegium, the former law minister claimed that at least collegium is able to stop the excessive use of the government.
“Imagine, in the state of democracy that we have, if the government alone have the exclusive rights to appoint judges, what kind of havoc will happen this country,” he said and added, “Therefore while the collegium has not improved the system, I think the collegium is a prevent against rapid decline of the system.”
In answering another question, he mentioned that a coalition government delivers better than single party government.
