Giridih/Kolkata: On September 12, for the first time, New Giridih railway station received an express train by Indian Railways that connects the district to the state capital, Ranchi.

Subsequently, two Vande Bharat trains, one running from Ranchi to Howrah and another from Patna to Howrah, passing through the main stations of Jharkhand, were introduced.

The media published a timetable for the Khandoli Express train, scheduled to run between Patna and Howrah from October itself. All these developments might lead one to believe that significant improvements are occurring in train services and that Giridih would benefit the most. However, these changes did not affect the lives of commuters in the way one might expect.

Giridih and Indian Railways

Giridih had a railway station in 1871 itself. But it never got an express train. Now, it has two stations– Giridih and New Giridih. Last September, New Giridih got an intercity express.

Ironically, as far as improving the rail facilities in Giridih is concerned, the “Lifeline of India” did not change much for the 32 lakh people of the district. When the new Giridih-Ranchi Intercity train was inaugurated, it was done with great fanfare, with Members of Parliament from Koderma and Giridih, Annapurna Devi, and CP Choudhury, in attendance.

The timing of the new Giridih-Ranchi express train (18618) is the opposite of what would benefit travelers. The train begins its journey to the state capital in the second half of the day at 2:30 pm and departs from Ranchi at 6 am. Every day, at least a dozen buses travel between Giridih and Ranchi from 4 am to 12 noon. The train schedule should be adjusted so that people can travel to the state capital in the morning and return in the evening using Indian railways.

“If the train timings do not change, it will not generate sufficient revenue for the South Eastern Railway Zone, potentially giving them a reason to discontinue it. The individuals taking credit for introducing the express train to Giridih should ensure practical timings that benefit passengers,” said a railway official at Giridih station, speaking anonymously.

The Vande Bharat trains do not stop at Dhanbad or Madhupur, which is a significant issue. Dhanbad, known as the coal capital of India, is the largest station in Jharkhand and has 56 pairs of trains passing through it daily. Patna’s Vande Bharat train also skips Madhupur, which is a major station compared to Jamtara and Jasidih, where it does stop. Adding a stop at Madhupur station would increase revenue since people from Giridih often choose to catch trains to other cities from there due to the absence of direct trains in their city.

Recently, vernacular media organizations published a timetable for the Khandoli Express, a Patna-Howrah bound train, suggesting that it would soon have a stop in New Giridih. However, it was later revealed that this was a suggestion from the Chamber of Commerce and not an official announcement from Indian Railways authorities.

Pradeep Agrawal, a member of the Zonal Railway Users’ Consultative Committee (Eastern Railway), confirmed that they are requesting South Eastern Railway Zone officials to change the timetable of the Ranchi-New Giridih train.

However, some observers with technical knowledge of train schedules believe that an express train from Patna to Howrah during daylight hours may not significantly benefit Giridih residents. As Patna is quite a distance from the city, the train will always be halfway, providing only partial benefit to Giridih commuters. Instead, they suggest sleeper trains departing around 10 pm from Giridih to reach Howrah in the morning, which could better address the long travel issue. Similarly, a 10 or 11 pm departure from Howrah to reach Giridih and Patna the next morning would provide an ideal timing.

The Palestine issue can not be confined to Hamas and its terror regime. The legitimacy of Hamas has come from the Western world just to create an alternative to the Palestinian Authority. In any society, when the liberal elements fail or are made to fail, the radical right-wing takes over. The right wings have never been the first choice but they thrive on the failure of the ‘secular’ ‘liberal’ element and have to take it all together. This is happening in most of the countries that were decolonised and a lot of credit to these radical right-wingers growing and getting access is the Western World as all these forces have their safe heavens in the Western world from where they speak about ‘human rights’, oppression and ‘democracy’ among others.

Israel-Palestine Conflict

The issue is why are people of Gaza are being punished for the fault of HAMAS. In any country or society, various forces are working to attain their freedom. The killing of civilians on both sides is extremely unfortunate and condemnable in no uncertain terms. Hamas governs Gaza and due to blockade in that region, its rule remains unchallenged. It always happens that a tyrannical regime rules in the absence of an environment for free and fair polling because of the continuing blockade. It suits all the parties. It suits Hamas as they have no challenge to their authority and it suits Israel well to project every Palestinians as terrorists.

Hamas’s act can’t be supported which killed innocent civilians but the question is shouldn’t Israel behave in a more civilised and responsible way? Israel had blockaded Gaza for the last fifteen years. Is it true that Hamas has provided Israel an opportunity to exterminate the people in Gaza?

The solution to the issue is not the ‘final solution’ by the extremely unpopular right-wing government in Israel. By exterminating about 1.5 million people, Israel is not creating a ‘final solution’ for it but it won’t be able to live peacefully. In the last fifty years, we have seen regular fights and bitter experiences. Israel may be a powerful country because it has the backing of the Western world but I don’t think they could sleep even a single day peacefully. This attack has exposed the chink in their armour that despite the best security apparatus and all digital devices their security was breached and so powerfully.

It is time for peace which can not happen without providing the Palestinians a rightful sovereign space of their own without any intervention by outsiders. Israel and Palestine need to live together. Both Israel and Palestine need to accept that they existed and historically have lived together as citizens of Palestine. It is time, they accept this historical fact. The problem was created by the West which ‘solved’ their problems in the aftermath of the Second World War by ‘settling’ the Jews in Palestine. The British and the Americans are solely responsible for this. The question is whether the trials at Nuremberg and in Japan after the Second World War were just sham and fake because the fact is why were the Jews not given land in the countries they were living in? Why should people living in a place for so many years be sent to a land they had left for a long?

Europe created this crisis and now, it is giving Israel a blank cheque to invade Gaza and exterminate it. How can the world accept such an ‘ultimatum’ to the inhabitants of a state to leave or get killed? Already, Gaza is being destroyed. The same European and American commentators were defending Ukraine’s right to self-defence but that right to self-defence does not exist with Palestine.

One reality of our time. Russia could have easily flattened Kyiv but it did not. It still waged a very professional war despite the big propaganda emerging in the Western capitals but today the big ‘respected’ Western media are showing the brutalities of Hamas by showing the pictures of the Palestinian children killed in the mindless, soulless bombing by Israel.

India could have seized this big moment as a power of the global south by initiating a peace dialogue. Instead, we looked happier in the company of the West and Indian cheerleaders have gone to ‘report’ to Indian people how ‘powerful’ Israel is. The aim is to legitimise similar acts in our territory. Israel therefore, became a role model for all the tyrannical regimes to suppress dissent and how to deal with the ‘obstacles’.

India’s historic position has been clarified by the Ministry of External Affairs and Palestine was a friend. Let the media understand that this is not a religious issue. It is not a Muslim Jew issue as both have lived together. It is an issue of decolonisation. Palestine needs their independence. Both Palestine and Israel will have to live together and accept the historical presence of both. India can play a historic role in negotiating a peace deal but for that just ignore your manustream darbaris shouting from the ‘battlefield’ who are not gone to report but just show you the tamasha for the sole purpose of making it convenient for their funders in the coming elections. Every international issue is being played for the domestic constituencies making it difficult for the diplomat to work with other countries.

This madness must stop. Say no to war. Give peace another chance. Accept both Palestine and Israel as two nations living side by side and peacefully.

IIT’s Unusual Stand: Refusing Support in Faizan Ahmed Murder Investigation

Kolkata: It should be disposed off, my lord,” interrupted Anindya Mitra, representing the Indian Institute of Technology, Kharagpur, in the murder case of Faizan Ahmed, a third-year Mechanical engineering student at IIT KGP. Judge Joy Sengupta, who was hearing arguments from Faizan Ahmed’s lawyer, Ranajit Chatterjee, despite the repeated interruptions, posed a question to senior counsel Mitra, “Without the SIT (Special Investigation Team) report?” There was silence for a few moments in the courtroom. “I will review the progress report and then decide,” said Justice Sengupta.

Two months later, the hearing in the IITian Faizan Ahmed murder case began before a new judge at the Calcutta High Court, in the courtroom of Justice Jay Sengupta. After the division bench upheld Justice Rajasekhar Mantha’s single bench decision, it was expected that both the IIT and the state would change their stance and support the victim’s family.

Ironically, unlike other cases that occurred within campus boundaries, IIT authorities never cooperated with the family and opposed the proceedings at every level.

Today, Anindya Mitra, the IIT counsel, reiterated that there isn’t much to the case and that it should be disposed off. The SIT has yet to file a progress report on one of the most brutal murder cases involving a student studying at one of India’s premier institutes.

During the hearing, at one point, Faizan’s counsel, Ranajit Chatterjee, had to ask the court, “What is the problem for IIT if the case remains pending?”

“The court also stated that it will first ensure that the victim’s side receives their rights, and then they will consider what should happen to the case,” Aniruddha Mitra, another lawyer for Faizan, told eNewsroom.

Faizan’s mother, Rehana Ahmed, has also expressed shock and concern as to why IIT is not supporting her in seeking justice but opposing it with all its might.

She wondered, “Who does IIT wants to protect?”

Notably, as on the last date, October 9, no one from the state was present.

The court scheduled Tuesday, October 17, as the next hearing date.

जब शव मिला तो खड़गपुर पुलिस और आईआईटी अधिकारियों दोनों ने दावा किया कि फैजान ने अवसाद के कारण आत्महत्या की है। हालांकि, परिवार ने इसे स्वीकार नहीं किया। माता-पिता कलकत्ता उच्च न्यायालय चले गए। पहली पोस्टमॉर्टम रिपोर्ट में मौत का कारण बताया गया कि फैजान ने अपने बाएं हाथ की नसें काट ली थीं, जिससे बहुत खून बहा और उसकी मौत हो गई। लेकिन यह जस्टिस राजशेखर मंथा की अदालत को संतुष्ट नहीं कर सका। जिन्होंने मौत के कारणों का पता लगाने के लिए फॉरेंसिक विशेषज्ञ डॉ अजॉय गुप्ता को नियुक्त किया। फोरेंसिक विशेषज्ञ ने पहले शव परीक्षण के वीडियो क्लिप देखने के बाद बताया कि फैज़ान के शरीर में हेमेटोमा (मतलब शरीर में चोट के निशान) हैं।  इसलिए उन्होंने कलकत्ता उच्च न्यायालय से दूसरे शव परीक्षण का अनुरोध किया। डॉ गुप्ता ने अदालत से कलकत्ता मेडिकल कॉलेज में नए सिरे से शव परीक्षण कराने की भी मांग की, जिसे अदालत ने मंजूर कर लिया। पहला शव परीक्षण मेदिनीपुर मेडिकल कॉलेज में किया गया।

फैजान का शव कब्र से दुबारा निकालकर डिब्रूगढ़ से कोलकाता लाया गया। दूसरे पोस्टमॉर्टम में डॉक्टर गुप्ता के साथ पहली बार शव परीक्षण करने वाले डॉक्टर और फैजान की मां भी मौजूद रहीं। ताजा पोस्टमार्टम की रिपोर्ट से यह स्पष्ट हो गया कि फैज़ान की मौत ‘हत्या’ थी। रिपोर्ट का अध्ययन करने के बाद, न्यायमूर्ति मंथा ने वरिष्ठ आईपीएस अधिकारी के जयारमन के नेतृत्व में एक विशेष जांच (एसआईटी) का गठन किया।

गौरतलब है कि आईआईटी खड़गपुर और बंगाल पुलिस, मुख्य न्यायाधीश टीएस शिवगणम और न्यायमूर्ति हिरणमई भट्टाचार्य की खंडपीठ के पास चले गए। जबकि आईआईटी खड़गपुर जस्टिस मंथा का हवाला देकर मामले को रद्द करना चाहता था, उसने एकतरफा सुनवाई की और बंगाल पुलिस चाहती थी कि एसआईटी नहीं बल्कि खड़गपुर पुलिस जांच करे। हालांकि, मुख्य न्यायाधीश शिवगणनम और न्यायमूर्ति भट्टाचार्य ने न्यायमूर्ति मंथा के फैसले को बरकरार रखा।

मीडिया में ज्यादा कवरेज नहीं, राज्य और आईआईटी से भी कोई समर्थन नहीं

कैंपस में रैगिंग और हत्या के किसी भी अन्य मामले से विपरीत, फैज़ान के मामले को न तो मीडिया में सही से स्थान मिला और न ही समाज का समर्थन। विडंबना यह है कि राज्य सरकार और आईआईटी अधिकारियों ने भी इस मामले में परिवार की मदद नहीं की, वास्तव में दोनों न्याय की तलाश में परिवार के खिलाफ खड़े हैं। डिवीजन बेंच में सुनवाई के दौरान चीफ जस्टिस शिवगणनम और जस्टिस भट्टाचार्य ने अपने आदेश में कहा कि, राज्य को दूसरे पोस्टमार्टम के निष्कर्षों से ज्यादा चिंता इस बात की है कि मामले की जांच एसआईटी न करे।

माँ रेहाना ने दुख जताते हुए कहा, “मैंने मुख्यमंत्री ममता बनर्जी को लिखा और मीडिया के माध्यम से उनसे कई अपील की, और पश्चिम बंगाल अल्पसंख्यक आयोग के अध्यक्ष को भी लिखा, लेकिन उनकी ओर से एक भी शब्द नहीं सुना गया।”

उन्होंने ईन्यूज़रूम को आगे बताया, “एक साल पहले, जब मेरे बेटे का शव मिला था, तो मेरे दिमाग में यह था कि मुझे आईआईटी खड़गपुर के अधिकारियों से समर्थन मिलेगा, लेकिन आज, जिस तरह से आईआईटी अधिकारी मेरे न्याय के रास्ते में खड़े हैं, इससे मुझे परेशानी हो रही है। आखिर वे किसे बचा रहे हैं?”

फैज़ान के मामले का भाग्य

इस पर आम आदमी का भी ध्यान देने की जरूरत है, जिसे न्याय मांग रहे परिवार की आवाज भी बनना चाहिए।

“फैज़ान की हत्या न केवल हमारे लिए, बल्कि देश के लिए भी क्षति है। वह प्रतिभाशाली होने के साथ-साथ बहुत अच्छे इंसान भी थे। वह समाज और देश के लिए बहुत कुछ करना चाहता था, ” पिता सलीम अहमद ने कहा।

फैजान के वकील रानाजीत चटर्जी ने ईन्यूजरूम से कहा, ”लंबी लड़ाई के बाद हमें एक एसआईटी मिली, लेकिन हमें नहीं पता कि वह मामले में क्या प्रगति कर रही है। आज (9 अक्टूबर) को भी सुनवाई थी, लेकिन राज्य सरकार पेश नहीं हुई।”

16 अगस्त के बाद से मामले की कोई सुनवाई नहीं हुई है, जब मुख्य न्यायाधीश शिवगणम और न्यायमूर्ति भट्टाचार्य की खंडपीठ ने दोहराया कि फैज़ान की मौत प्रकृति में हत्या है और एसआईटी जांच जारी रखेगी।

তিনি ছিলেন তার বাবা-মা রেহানা ও সেলিম আহমেদের একমাত্র সন্তান।

ঠিক এক বছর আগে, 11 অক্টোবর, 2022-এ, 23-বছর-বয়সীকে নৃশংসভাবে খুন করা হয়েছিল এবং তিন দিন পরে তার আইআইটি খড়গপুরের হোস্টেলের ঘর থেকে তার আংশিকভাবে পচা মৃতদেহ উদ্ধার করা হয়েছিল।

আত্মহত্যা থেকে হত্যা

মৃতদেহ পাওয়া গেলে, খড়্গপুর পুলিশ এবং আইআইটি কর্তৃপক্ষ উভয়েই দাবি করেছে যে ফাইজান হতাশার কারণে আত্মহত্যা করেছে। যদিও পরিবার তা মেনে নেয়নি। অভিভাবকরা কলকাতা হাইকোর্টে যান। প্রথম পোস্টমর্টেম রিপোর্টে মৃত্যুর কারণ উল্লেখ করা হয়, ফাইজানের বাম হাতের রগ কেটে যাওয়ায় তার মৃত্যু হয়েছে। কিন্তু তা বিচারপতি রাজশেখর মন্থার আদালতকে সন্তুষ্ট করতে পারেনি। যিনি একজন ফরেনসিক বিশেষজ্ঞ ডাঃ অজয় গুপ্তাকে মৃত্যুর কারণ নির্ণয়ের জন্য নিযুক্ত করেছিলেন। ফরেনসিক বিশেষজ্ঞ প্রথম ময়নাতদন্তের ভিডিও ক্লিপগুলি দেখার পরে নির্দেশ করেছিলেন যে ফাইজানের শরীরে হেমাটোমার চিহ্ন রয়েছে তাই তিনি কলকাতা হাইকোর্ট থেকে দ্বিতীয় ময়নাতদন্তের আবেদন করেছিলেন। ডাঃ গুপ্তা আদালতকে কলকাতা মেডিক্যাল কলেজে নতুন ময়নাতদন্ত করতে বলেছিলেন, যা আদালত মঞ্জুর করেছিলেন। প্রথমটি মেদিনীপুর মেডিকেল কলেজে করা হয়।

বাবা সেলিম আহমেদ বলেন, “ফাইজানের হত্যাকাণ্ড শুধু আমাদের জন্য নয়, দেশেরও ক্ষতি। তিনি একজন মেধাবী এবং একজন ভালো মানুষ ছিলেন। তিনি ছিলেন সমাজ ও দেশের জন্য একটি সম্পদ।”

ফাইজানের আইনজীবী রণজিৎ চ্যাটার্জি ইনিউজরুমকে বলেন, “দীর্ঘ যুদ্ধের পর, আমরা একটি এসআইটি পেয়েছি, কিন্তু আমরা জানি না এই মামলায় কী অগ্রগতি হচ্ছে। আজ (৯ অক্টোবর) শুনানিও হয়েছে, কিন্তু রাষ্ট্রপক্ষ হাজির হয়নি।

Unsolved Mystery: The Tragic Murder of IIT KGP’s Faizan Ahmed

Kolkata: Securing the 11th rank in the Joint Entrance Exam (JEE) remains a dream for many aspirants. And then becoming a member of two national level Robotics research teams in Indian Institute of Technology Kharagpur. A guy who was getting a scholarship from the Assam government because he had excellent study records.

During his IIT days he used to teach mathematics online. He was also receiving payment in dollars.

The above story is one of India’s brilliant minds– Faizan Ahmed. A resident of Tinsukia, Faizan was a third year mechanical engineering student of IIT Kharagpur.

He was the only child of his parents– Rehana and Salim Ahmed.

Exactly one year ago, on October 11, 2022, the 23-year-old was brutally murdered and three days later his partially decomposed dead body recovered from his hostel room in IIT Kharagpur.

From suicide to homicide

When the dead body was found, both Kharagpur Police and IIT authorities claimed that Faizan committed suicide due to depression. However, the family did not accept it. The parents moved to Calcutta High Court. In the first postmortem report, the cause of death was mentioned that Faizan had cut veins of his left hand and as a result of which he died. But it could not satisfy the court of Justice Rajasekhar Mantha. Who appointed a forensic expert Dr Ajoy Gupta to ascertain the cause of death. The forensic expert after going through the video clips of the first autopsy pointed out that there are signs of hematoma in the body of Faizan so he requested a second autopsy from Calcutta High Court. Dr Gupta also asked the court to get the fresh autopsy done in Calcutta Medical College, which the court granted. First one was performed at Medinipur Medical College.

After getting exhumed, Faizan’s body was brought from Dibrugarh. In the second postmortem, first time doctor and mother of Faizan were also present along with Dr Gupta. The report of a fresh postmortem made it clear that Faizan’s death was ‘homicide’ in nature. After going through reports, Justice Mantha constituted a Special Investigation (SIT) led by senior IPS officer K Jayaraman.

Significantly, IIT Kharagpur and Bengal police moved to the division bench of Chief Justice TS Sivagnanam and Justice Hiranmai Bhattacharyya. While IIT Kharagpur wanted to quash the case citing Justice Mantha did one sided hearing and Bengal police did not want SIT but Kharagpur police to investigate. However, Chief Justice Sivagnanam and Justice Bhattacharya upheld the decision of Justice Mantha.

Not much coverage in media, no support from state and IIT either

Unlike any other case of ragging and murder on campuses, Faizan’s case doesn’t receive the attention of the media nor the support of civil society. Ironically, state government and IIT authorities too did not help the family in the case, in fact both stand against the family in their quest for justice. During the hearing in the division bench, Chief Justice Sivagnanam and Justice Bhattacharya mentioned in their order that, state was more concerned that SIT should not investigate the case, than the findings of the second postmortem.

“I wrote to chief minister Mamata Banerjee and made several appeals to her through the media, and wrote to the chairman of West Bengal Minority Commission as well, but did not hear a word from them, ” rued Rehana, the grieving mother.

She further told eNewsroom, “One year back, when my son’s dead body was found, it was in my mind that I will get support from IIT Kharagpur authorities, but today, they way IIT authorities stand on my way to justice, it hounds me regularly, to whom they are saving?”

Fate of Faizan’s case

It also requires the attention of the common man, who should also become the voice of the family seeking justice.

“The murder of Faizan is not only a loss for us, but the country too. He was a genius as well as a very good human being. He was an asset for society and country,” said Salim Ahmed, the father.

Faizan’s lawyer Ranajit Chatterjee told eNewsroom, “After long battle, we got an SIT, but we do not know what progress it is making in the case. Today (October 9), there was also a hearing, but the state did not appear.”

No hearing of the case has taken place since August 16, when the Division Bench of Chief Justice Sivagnanam and Justice Bhattacharyya reiterated that Faizan’s death is homicide in nature and SIT will continue the investigation.

The crisis in West Asia is an abject failure not only of the so-called ‘omnipotent’ ‘intelligence’ of Israel but also of the Western countries who have given carte blanche to Israel without any international accountability. Hamas’ actions can be termed as ‘brutal,’ but the fact is that it is an organization fighting for Palestinian rights, which Israel regularly violates. The conditions in the Gaza Strip are said to be extremely adverse for human living, as Israel can enter it at its whims and fancies, converting it into an open-air jail. Western governments have shamelessly allowed such human rights violations to happen and are now caught in their own trap.

Israel is a powerful country that thinks it can violate international borders and eliminate people at will. The fact is, the Jewish lobby internationally is financially powerful and exerts influence over the United States. The irony of the situation is striking. Those who exterminated Jews in Germany and elsewhere have become best friends. Those who bombed Germany and Japan are the ‘allies,’ while they criticize Russia and its army, which actually protected the world from the Nazism of Hitler, as enemies. For the right-wing, it’s best to say less. They express support for both Hitler and Jews, and Israel. You can’t find such a low level of IQ anywhere else in the world.

Without understanding the historicity of the issue, we will go nowhere if we believe that Palestinians have no right to life. What has been happening in Gaza is nothing but torture. But the Western world has been ignoring and sleeping. Violence breeds violence.

The attack has surprised and shocked Israel, and it has declared war on Palestine, which has already been in conflict for the last 75 years. This problem was created by Britain and Americans to maintain their hegemony in the Middle East. Today, they have been caught napping. Now, Israel’s counter-attack will be used to kill people. Innocent people are being killed, either by Hamas or Israel, and such deaths will continue if a settlement is not reached. Why are the Western world unable to do so? Do they want an unstable Middle East so that their hegemony is not challenged?

There is no doubt that killing innocent civilians is a war crime. There is every possibility of an escalation of violence, and it must stop immediately. Long ago, Israel destroyed Iran’s nuclear facilities due to their alleged support for Palestinian groups. Today, there is every chance that the war can escalate, and Iran is not sitting idle, waiting for an attack on it. The world is still grappling with the Ukraine war. Now, this fresh conflict will further aggravate the crisis. The question is, will the international powers now intervene in Palestine as they have done in Syria?

Will Russia and China get involved in the crisis? If that happens, it would be extremely dangerous. India must tread its path carefully, keeping its own geopolitical interests in mind, and allow diplomacy to take its course while protecting the interests of Indian nationals living in the Middle East. It must be prepared for any emergency in case the crisis escalates to other countries. This is not the time for rhetoric but for serious introspection.

This attack on Israel is their 9/11 moment. The response from their side will be lethal. But it needs to be seen whether it will be confined to Gaza or cross other international borders. If that happens, we are living in uncertain times now. Will the West join hands in ‘punishing’ Iran? That is the biggest question. Hamas or no Hamas, the real challenge for Israel would be dealing with Iran.

The real answer to these issues is not the complete elimination of the Palestinians but a discussion of peace. Both the Palestinians and Israel must accept each other’s right to live independently and without fear. International boundaries need to be created and respected. Palestinians have the right to their homeland, and it is a historical issue, not something that has happened overnight.

India has supported the Palestinian cause. Yasir Arafat was a much-respected leader in India. Of course, we now have good relations with Israel. But rather than using the Israel-Palestine conflict for narrow domestic political gains and creating a hate agenda against Muslims, it would be better for India to continue watching the situation and taking initiative. Lately, India has developed good relations with Iran. What would happen if Iran is drawn into the conflict?

The BJP has started using the conflict for whataboutery. Bringing up an international issue with a historical context for narrow political gains is nothing but hypocrisy. You can’t support both Hitler and Israel at the same time.

You can deal with Hamas, but do the people of Gaza have a right to a dignified life or not? Do the Palestinians have the right to a dignified life or not? The UN must intervene effectively in this, as any failure will only help Western arms industries and escalate the war in the Middle East, which will further strain our already fragile economies. War is not the answer, and peace is not possible while living in denial mode. Israel and Palestine are realities and must accept each other’s existence. No peace will be possible if anyone denies the existence of the other. Many times, the internationalization of the issue does not help and is detrimental to the rights of the people. Peace is the need of the hour, but how it will be achieved is the real challenge.

Meanwhile, the brutalities that are being projected on TV channels and the celebrations of killing innocent lives, humiliating soldiers and women, cannot be supported or appreciated. We unequivocally condemn them. Don’t deny people and soldiers their dignity in conflict. Women are the biggest victims of war. Attempts should be made to end this conflict. For that, both countries must come out of denial mode. Also, international players need to sit and talk honestly. Decide on the international borders of Palestine and Israel and resolve the conflict. The world cannot afford these endless conflicts that only strengthen the powerful arms industries everywhere. Stop this madness.

23 Media Groups Write to CJI Chandrachud, Condemn NewsClick Raids, Arrests, Demand Judicial Intervention

Kolkata: Since the raids and arrest of NewsClick journalists and its founder as well as employees have taken place, a large number of media organizations and civil society have strongly condemned it.

The houses and offices of at least 37 journalists, writers and employees of independent media organization NewsClick was raided by Delhi Police’s Special Cell on Tuesday morning. It continued till night and after the questioning, while 37 were released, its founder Prabir Purkayastha and Human Resource (HR) department Head Amit Chakravarthi was arrested. They have been sent for 7 days police custody.

While NewsClik has issued an statement and claimed that, they have still not been given copy of FIR and details of offences.

It also said, “We strongly condemn these actions of a Government that refuses to respect journalistic independence, and treats criticism as sedition or ‘anti-national’ propaganda.”

The 73-year-old Purkayastha was also sent to jail during Emergency in 1975, while the HR Head Chakravarthi is physically challenged and uses crutches to move. 

The National Platform for the Rights of the Disabled (NPRD) has also condemned the attack on the independent media outlet.

It writes, “The news portal has been consistently championing the cause of the marginalised sections including disabled people. In this people-centric approach, the portal has been consistently carrying reports and articles on various struggles and issues of the disabled community and sought to lend a voice to their issues.”

“One of the two detained and remanded to police custody is Mr. Amit Chakravarthi, a polio survivor and person with disability, who uses crutches. As a person with disability, he has a right to be protected from inhuman treatment and torture.”

And reminds the agencies that, “Article 25 of the United Nations Convention on Rights of Persons with Disabilities (UNCRPD) affirms that the State shall ‘Prevent discriminatory denial of health care or health services or food and fluids on the basis of disability.’ The Rights of Persons with Disabilities Act, 2016 under Section 6 provides for “Protection from cruelty and inhuman treatment”. In addition to the legislation and convention on disability the right to protection from torture, cruel, inhuman and degrading treatment and the right to be treated with humanity and respect for inherent dignity for those lawfully deprived of their liberty is specified under Articles 7 & 10 of International Covenant on Civil and Political Rights (ICCPR).”

The NPRD demanded that all reasonable accommodations should be provided to Amit Chakravarti while he is in custody. Until his release, he should be lodged in a facility that takes care of his accessibility needs. His other needs as a disabled person should be complied with, including but not restricted to health concerns.”

Along with them, ten independent media organizations from West Bengal have issued a statement and argued that the people of India, not blindly trust the Enforcement Directorate (ED) and Central Bureau of Investigation (CBI) whose success rate is only 0.04 percent and 3 percent respectively. They have been criticised by the Supreme Court from time to time.

“We urge the people of India to resist this attack and not blindly trust the Enforcement Directorate, whose success rate is only 0.04% and whose work has been criticised by the Supreme Court. Similarly, the Central Bureau of Investigation’s success rate in corruption cases is just 3%, so their statements should also be carefully considered. Additionally, the Delhi Police’s role in the 2020 Delhi riots has been criticised by a respected judge, so their actions must also be scrutinised. These agencies have resorted to illegal tactics to harass our fellow citizens, while certain media outlets have diverted public attention elsewhere. Therefore, protesting is the only way to resist this attack. We implore you to take a stand and support our protest,” it reads.

Also, 23 organisations of journalists and media outlets across India have together written a joint letter to Chief Justice of India DY Chandrachud, forwarding an earnest plea seeking the judiciary’s attention to the attacks on press freedom in the country.

Dear Chief Justice Chandrachud,

We write this letter as a voluntary and free coalition of organisations that represent the free press and who are committed to upholding the values of freedom of speech and expression enshrined in our Constitution.

This letter is an earnest plea to the sentinel on the qui vive, weather-beaten as that phrase may have become—an appeal from one institution that is essential for the exercise of freedom and democracy in India, to one that is Supreme and is sworn to protect the Constitution that enshrines those freedoms.

We write this letter conscious of the fact that it is addressed not just to the Chief Justice of India but to an incumbent who has said, within the court and outside, that the “press has a duty to speak truth to power and present citizens with hard facts enabling them to make choices that propel democracy in the right direction” and that India’s freedoms will be safe as long as journalists can play this role “without being chilled by a threat of reprisal”.

The fact is that today, a large section of journalists in India finds itself working under the threat of reprisal. And it is imperative that the Judiciary confronts Power with a fundamental Truth—that there is a Constitution to which we are all answerable.

On October 3, 2023, the Special Cell of the Delhi Police raided the homes of 46 journalists, editors, writers, and professionals seemingly connected in one way or another to the online news portal, NewsClick. The raids led to the arrest of two persons under various sections of the Unlawful Activities (Prevention) Act, and the seizure of mobile phones and computers without ensuring the integrity of their data—a basic protocol that is essential to due process. The invocation of UAPA is especially chilling. Journalism cannot be prosecuted as ‘terrorism’. Enough instances in history abound to tell us where that eventually goes.

During your time at the Supreme Court, you have seen how on numerous occasions, the country’s investigating agencies have been misused and weaponised against the Press. Sedition and terrorism cases have been filed against editors and reporters, and multiple, sequential and/or frivolous FIRs have been used as an instrument of harassment against journalists.

The purpose of addressing this letter to you is not to bypass or circumvent the process and procedure established by law. But when journalists are summoned and their devices seized in the name of investigation, there is an inherent malice in the process that must be checked.

Just as the police are obliged by the Constitution to state the grounds of arrest, it must equally be a precondition to questioning. In its absence, as we have seen in the NewsClick case, vague assertions about the investigation of some unspecified offence have become the grounds for questioning journalists about their coverage of, inter alia, the farmers’ movement, the government’s handling of the Covid pandemic and the protest against the Citizenship (Amendment) Act.

We do not say that journalists are above the law. We are not and do not wish to be. However, intimidation of the media affects the democratic fabric of society. And subjecting journalists to a concentrated criminal process because the government disapproves of their coverage of national and international affairs is an attempt to chill the press by threat of reprisal—the very ingredient you identified as a threat to freedom.

Wide powers of investigation are given to the state on the assumption of bonafides on the part of its agencies. Equally, a wide immunity against coercion must be read into the constitutional provisions of free speech, and methods must be devised against police overreach—especially given the repeated misuse of these powers. Far too much is at stake to test every case at the end of a trial which can last years.

Journalists arrested under UAPA can end up spending months, if not years, behind bars before they are even granted bail. We already have the case of Siddique Kappan before us; he was incarcerated for two years and four months before finally securing bail. The tragic death of Father Stan Swamy in custody is a reminder of how indifferent the authorities seem to have become towards human life under the guise of combating ‘terrorism’.

Our fear is that state actions against the media have been taken beyond measure, and should they be allowed to continue in the direction they are headed, it may be too late for corrective or remedial steps. It is, therefore, our collective view that the Higher Judiciary must now intervene to put an end to the increasingly repressive use of investigating agencies against the media.

Specifically, we would be obliged if the courts would consider:

1. The framing of norms to discourage the seizure of journalists’ phones and laptops on a whim, as has been the case. The Supreme Court is seized of this issue in a writ petition filed by noted academics—Ram Ramaswamy & Ors. v. Union of India, W.P. (Crl) No. 138/2021 – and has not been satisfied by the affidavits filed by the Union of India in these proceedings. While the wheels of justice have been turning, the State has continued to act with impunity. The seizure of devices compromises our professional work. As the Supreme Court itself has observed (in the Pegasus matter), the protection of sources is an “important and necessary corollary” of freedom of media. But laptops and phones are no longer just official tools used to conduct official business. They have fundamentally become an extension of one’s self. These devices are integrated into our entire lives and have vital personal information contained in them—from communication to photographs to conversations with family and friends. There is no reason or justification that investigating agencies should have access to such material.

1. Evolving guidelines for the interrogation of journalists and for seizures from them, to ensure that these are not undertaken as fishing expeditions with no bearing to an actual offence.

1. Finding ways to ensure the accountability of State agencies and individual officers who are found overstepping the law or willfully misleading courts with vague and open-ended investigations against journalists for their journalistic work.

We, the undersigned, write this letter to your lordship after considerable thought and contemplation.

There have been many instances over the past few years when assaults on the free press by the State have required judicial intervention, and we continue to pursue such cases. But the developments over the past 24 hours have left us no option but to appeal to your good conscience to take cognisance and intervene before it is too late and an autocratic police state becomes the norm.

As journalists and news professionals, we are always ready and willing to cooperate with any bona fide investigation. However, ad hoc, sweeping seizures and interrogations surely cannot be considered acceptable in any democratic country, let alone one that has begun advertising itself as the ‘mother of democracy’.
